2. Execution of the POA

Once the POA draft is ready, follow these steps for execution:

  • Print the POA on plain paper or document paper, as required.
  • The principal (property owner), attorney, and two witnesses must sign the POA

3. Register the POA for a valid sale transaction

To make the POA valid for a sale transaction, it must be registered at the sub-registrar’s office. Follow these steps:

  • Scan the signed POA document
  • Download the latest Aadhaar copy of all parties and witnesses
  • Submit the application on Kaveri Online Services, pay the required stamp duty, and book the registration slot.
  • Visit the sub-registrar’s office at the scheduled time to complete the registration process.

POA EXECUTED ABROAD

If the POA is signed outside India, the process remains the same for drafting and execution, with an additional step:

  • The POA must be notarized or attested by the Indian consulate in the foreign country
  • Upon arrival in India, the POA must be adjudicated for Stamp Duty in the District Registrar’s office in Bangalore before using it for deed registration

How to give Power of Attorney from abroad for closing home loan in India?

Once the home loan is paid off, the bank will send a loan closure letter to your registered email ID

The loan closure letter looks like the below image

In the same email, tell the bank that you live abroad and want to use a Power Of Attorney (POA) to collect property documents.

Please note the below mock response to the bank:

The bank will schedule a time to collect property documents and send an email with a POA format; typically, the bank provides an appointment within 15 working days

For example: The appointment date for document collection would be August 16th if the bank had issued an email confirming the appointment on August 1st.

Though the appointment date is August 16th, most banks allow for an additional 30 working days as buffer time

You should not panic if you miss the appointment date. In some countries, obtaining the POA within 15 working days can be challenging, which is why we mentioned the buffer period.


We are sharing the approximate timeline and process for carrying out the POA from abroad:

Day 1:

The bank emails a POA in Word document format. The POA’s majority of terms remain the same; we only need to add necessary details like;

  • Name, Age, Name of Father or spouse, Residential address, Loan account number and property schedule
  • Print the POA draft
  • Affix passport-size photo

Day 2:

Book an appointment with your country’s notary public. Most of the time, notary appointments are scheduled for the same day, however in the few USA and European countries, appointments must be scheduled at least three or seven days in advance.

Let’s consider the notary appointment takes, an average of 5 working days (from day 2 to day 6)

Day 6:

  • Meet the notary public and sign the POA in front of Notary
  • Notary attest and sign the POA

Once the notary is done, send the following documents to India that same day:

  • POA
  • Two sets of Self-attested identification proofs (Passport/OCI and PAN). One for adjudication in District Registrar’s office and another for document collection in bank in India

DHL/FedEx typically delivers packages in 5–7 business days. while the majority of other shipping firms require 10–15 working days

Let us consider an average of 10 working days for shipment (from day 6 to day 16)

Day 16:

The package arrives in India. let us consider the package arrived in the afternoon

Your POA holder (the person you granted the POA) in India opens the package, affixes his/her passport-size photo, and signs the POA

Print a copy of a letter requesting a POA adjudication from the district registrar’s office. Please review the sample request letter below

Print a copy of POA holder identification proof (Aadhaar and PAN)

Day 17:

The following documents are brought to the District Registrar’s office (DRO) by the POA holder:

  • POA (came from abroad)
  • Self-attested Identification proof (came from abroad)
  • Request letter
  • Identification proof of POA holder

The DRO personnel validates the aforementioned documents and requests payment of the stamp duty (in Karnataka, we pay Rs. 500 stamp duty on the Khajane-2 website and give the DRO officer the payment challan)

Day 18:

Pick up the POA at the DRO at around 10 am (after the DRO seal and sign). Visit the bank to collect property documents that same day. Bring the following documents to the bank

  • Original POA
  • Self-attested identification proofs (both executant and POA holder)

After validating the aforementioned documents, bank staff gives the original property documents

Additionally, the bank staff will hand over the Discharge Deed/ Reconveyance Deed to remove home loan lien registered in sub-registrar office.

How do I cancel a Power of Attorney from outside India?

  • Power of Attorney (POA)
  • The principal is the person who grants the POA
  • The agent is the person who receives the POA

We can cancel a Power of Attorney from outside India and we explained the detailed procedure below


The principal cancels the POA in various circumstances. Below are few:

  • Lost of Trust
  • Change in relationship
  • Change in requirement or purpose
  • When the purpose of the POA has come to an end
  • When the agent becomes insolvent or unsound mind
  • Gross mismanagement on agent’s part
  • Agent breaches the contract terms or acts beyond his/her scope of power

Procedure to cancel the Power of Attorney from abroad:

  • Draft the “Revocation of POA”
  • Print the draft on A4-size paper
  • Principal Sign the “Revocation of POA”
  • Attest the “Revocation of POA” from notary or consulate in the country you reside
  • Send the “Revocation of POA” to India

In India, your representative submits the below documents to Registrar’s Office for adjudication

  • Revocation of POA
  • Photocopy of POA (which you executed earlier and want to cancel now)
  • Photocopy of principal’s and Agent’s ID proof

The registrar’s office verifies the above documents and your representative pays the required stamp duty

The registrar’s office adjudicates the “Revocation of POA”

The Registrar’s office hands back the original “Revocation of POA” and retains the photocopy

This completes the procedure.


Let me share my experience of canceling the POA:

My client lives in Texas, USA. He owns a villa in Bangalore and he wants to sell his Villa.

Due to geographical and time constraints, my client could not look after the sale process. He granted General Power of Attorney (GPA) to his brother in India so his brother could look after the sale proceeds on his behalf.

Refer to the below GPA

After two months of exploring the market, we found a first-time home buyer whose consideration is Rs. 1.2 Cr. However, the buyer was not interested in buying through GPA. Because the buyer wants the actual owner to sign the sale deed and present biometric thumb impression in sub-registrar office for registration

The deal seemed lucrative, so we obliged the buyer’s request. We canceled the above GPA as the seller will come to India for deed registration

We followed the below procedure to cancel our GPA:

  • Drafted the “Revocation of GPA” in Word document
  • We emailed the draft to our client (who is in Texas, USA)
  • My client in Texas took the printout and signed
  • My client got notary attestation in “Revocation of GPA” in Texas
  • My client couriered the “Revocation of GPA” to India

In India, we submitted the following documents to the District registrar’s office for adjudication

  • Original “Revocation of GPA” (which came from Texas, USA)
  • Photocopy of GPA (which we executed 2 months ago)
  • Printout of Principal and agent ID proofs
  • Request letter addressing to District Registrar for adjudication of “Revocation of GPA”
  • The staff in the District registrar verified the documents and accepted them for adjudication
  • We paid the Stamp Duty of Rs. 500

Within the same day evening, our “Revocation of GPA” was Adjudicated and handed to us. Refer to below image

We shared the revocation copy with the buyer for his reference, Also we published it in two newspapers, one in Kannada and another in English language paper

This completes the procedure of canceling our GPA

How do I send Special Power of Attorney from abroad to sell a property in Karnataka?

Special Power of Attorney (SPOA)

A special power of attorney is a legal document that authorizes one person, called an agent or an attorney in fact, to act on behalf of another person, known as the principal, under specific, clearly laid-out circumstances.


Context: NRI (both husband and wife) lives in Sydney, Australia. They own a 2BHK flat in Bangalore, and want to sell this flat to reinvest in new property

NRI is not able to come to India for registration of sale deed in sub-registrar office, so they decided to give a power of attorney (POA) to a friend in India. When we give POA to friend who is a non-blood relative, the stamp duty is 5% of property value or guidance value, whichever is higher.

To reduce the stamp duty, we suggested to give SPOA. The stamp duty for SPOA is just Rs. 200 irrespective of relationship and property value (Edit on 9th Dec 2024, the revised Stamp Duty is Rs. 500)


NRI followed below steps to give SPOA to a friend in India

Step 1: Found the buyer to purchase the flat

Step 2: Drafted the SPOA and sale deed with the help of an advocate

Step 3: Printed the SPOA and sale deed draft on document paper

Step 4: NRI signed the SPOA on all pages and two witnesses signed at last page of SPOA

Step 5: NRI (Seller) signed sale deed

Step 6: NRI met the notary public near their place in Sydney and got the SPOA attested by notary public

Step 7: NRI couriered the SPOA and Sale deed to friend in India.

Step 8: The friend in India, carried the following documents to District Registrar’s office (DRO) for SPOA adjudication

  • SPOA and Sale deed which came from Australia
  • Photocopy of NRI’s OCI and PAN
  • Photocopy of friend’s aadhaar
  • Stamp duty payment (Khajane -2 challan)

In my case, the property is located in Kaggadasapura village, Bangalore. The Kaggadasapura village comes under Shivajinagar District Registrar office (DRO), we adjudicated the SPOA in Shivajinagar DRO.

We used the above SPOA and sale deed to sell the property in Bangalore, India.


Note:

  • In the above answer, friend is referred to an agent or an attorney of the SPOA.
  • Unlike POA and GPA, we should find buyer for the property before we execute SPOA because we should present the signed sale deed along with SPOA for adjudication in DRO.
  • SPOA attestation by notary public is accepted for deed registration,  attestation from Indian embassy is not mandatory.
  • If we refer to the above sale deed, that kind of document paper was not available in Sydney, we couriered the document paper to Sydney for buyer to take print and sign. However it’s not mandatory to use above-mentioned document paper, they could have used any A4 size around 150GSM paper
  • If you refer to the above SPOA, there are two Principal (Husband & wife), the stamp duty payable is Rs. 200 per principal so we paid the total of Rs. 400 as Stamp duty, refer to below payment challan

Stamp Duty:

  • ₹1,000 per executant (if registered within India)
  • ₹500 per executant (if executed abroad)
  1. Power of Attorney for Selling Property

A POA for selling can also be granted to anyone, including non-blood relatives.

Stamp Duty:

  • ₹1,000 per executant (if registered within India).
    • For non-blood relatives: Additional stamp duty of 5% of the sale consideration or guidance value, whichever is higher.
  • ₹500 per executant (if executed abroad)
    • For non-blood relatives: Same additional 5% stamp duty as above

How to Give Power of Attorney to Your Brother in India from the USA

Granting a Power of Attorney (POA) to your brother in India while residing in the USA is a structured process. Here is a step-by-step guide to help you navigate it smoothly:

STEP 1: DRAFT THE POA

Prepare the POA document in Microsoft Word format, clearly outlining the powers being granted to your brother.

STEP 2: PRINT THE DOCUMENT

Print the drafted POA on standard A4-size paper. (There is no need to use stamp paper)

STEP 3: NOTARIZATION IN THE USA

  • Visit a licensed Notary Public near your location.
  • Sign the POA document in the presence of the Notary.
  • The Notary will affix their seal and signature to authenticate the document.

STEP 4: SENDING THE POA TO INDIA

Courier the notarized POA document to your brother in India through a reliable postal or courier service.

STEP 5: ADJUDICATION IN INDIA

Upon receiving the POA, your brother must present the following documents at the District Registrar’s Office for adjudication:

  • The original notarized POA.
  • Valid ID proofs for both you and your brother (the ID proofs must establish your relationship, typically by matching the father’s name).
  • Stamp duty payment receipt.
  • A request letter addressed to the District Registrar.
  • A copy of the Sale Deed (if the POA is related to selling a property).

NOTE:
Adjudication must be conducted within the jurisdiction where the concerned property is located.

STEP 6: PROCESSING AT THE DISTRICT REGISTRAR’S OFFICE

The District Registrar will:

  • Verify the POA document, ID proofs, and stamp duty receipt.
  • Officially adjudicate the POA.

Upon completion, the Power of Attorney is legally recognized for use in India.


IMPORTANT NOTES:

  • In Karnataka, a notarized General Power of Attorney (GPA) from the USA is accepted for property transactions. Attestation from the Indian Embassy/Consulate is not mandatory.This is beneficial as embassy attestation typically involves higher costs and significant travel.
  • As of 28th April 2025, the stamp duty for POA adjudication in Karnataka has been revised to ₹500 (previously ₹200).
  • In certain other Indian states, attestation by the Indian Embassy is still mandatory, and notarized documents alone may not suffice. Always verify the current local regulations in the respective state before proceeding.

EXAMPLE CASE:

Mr. Krishna Mohan, residing in the USA, granted a Power of Attorney to his brother, Mr. Ram Mohan, for the sale of a property located in Bangalore. The relationship was clearly indicated within the POA document, helping to establish its authenticity during adjudication.

Can a Power of Attorney Holder Sell Property to Themselves?

Yes, a person holding a Power of Attorney (POA) can legally transfer property to themselves—but only under specific conditions. The Power of Attorney document must explicitly authorize the Attorney (the person receiving POA) to do so.

The Executant (the person granting the POA) must clearly mention in the POA that the Attorney has the right to execute a sale or gift deed in their own favor. Without this specific clause, such a transfer could be challenged

Mr. Parul, a resident of London, owns a 2BHK flat in Bangalore. He wished to gift this flat to his mother, Mrs. Sarita. However, due to COVID-19 travel restrictions, he was unable to visit India to execute the Gift Deed personally.

To proceed with the transfer, Mr. Parul executed a General Power of Attorney (GPA) in favor of his mother.

Using the authority granted in the GPA, Mrs. Sarita transferred the property to herself by registering a Gift Deed.

IN THE GIFT DEED

  • Donor: Mr. Parul (represented by his POA holder, Mrs. Sarita)
  • Donee: Mrs. Sarita (also signing in her own individual capacity)

Thus, Mrs. Sarita signed the deed on behalf of the donor and as the donee herself, which is legally permissible as long as the GPA explicitly allowed this transfer.
