Adjudicate the POA at your respective District Registrar’s office.

How to give Power of Attorney from abroad for closing home loan in India?

Once the home loan is paid off, the bank will send a loan closure letter to your registered email ID

The loan closure letter looks like the below image

In the same email, tell the bank that you live abroad and want to use a Power Of Attorney (POA) to collect property documents.

Please note the below mock response to the bank:

The bank will schedule a time to collect property documents and send an email with a POA format; typically, the bank provides an appointment within 15 working days

For example: The appointment date for document collection would be August 16th if the bank had issued an email confirming the appointment on August 1st.

Though the appointment date is August 16th, most banks allow for an additional 30 working days as buffer time

You should not panic if you miss the appointment date. In some countries, obtaining the POA within 15 working days can be challenging, which is why we mentioned the buffer period.


We are sharing the approximate timeline and process for carrying out the POA from abroad:

Day 1:

The bank emails a POA in Word document format. The POA’s majority of terms remain the same; we only need to add necessary details like;

  • Name, Age, Name of Father or spouse, Residential address, Loan account number and property schedule
  • Print the POA draft
  • Affix passport-size photo

Day 2:

Book an appointment with your country’s notary public. Most of the time, notary appointments are scheduled for the same day, however in the few USA and European countries, appointments must be scheduled at least three or seven days in advance.

Let’s consider the notary appointment takes, an average of 5 working days (from day 2 to day 6)

Day 6:

  • Meet the notary public and sign the POA in front of Notary
  • Notary attest and sign the POA

Once the notary is done, send the following documents to India that same day:

  • POA
  • Two sets of Self-attested identification proofs (Passport/OCI and PAN). One for adjudication in District Registrar’s office and another for document collection in bank in India

DHL/FedEx typically delivers packages in 5–7 business days. while the majority of other shipping firms require 10–15 working days

Let us consider an average of 10 working days for shipment (from day 6 to day 16)

Day 16:

The package arrives in India. let us consider the package arrived in the afternoon

Your POA holder (the person you granted the POA) in India opens the package, affixes his/her passport-size photo, and signs the POA

Print a copy of a letter requesting a POA adjudication from the district registrar’s office. Please review the sample request letter below

Print a copy of POA holder identification proof (Aadhaar and PAN)

Day 17:

The following documents are brought to the District Registrar’s office (DRO) by the POA holder:

  • POA (came from abroad)
  • Self-attested Identification proof (came from abroad)
  • Request letter
  • Identification proof of POA holder

The DRO personnel validates the aforementioned documents and requests payment of the stamp duty (in Karnataka, we pay Rs. 500 stamp duty on the Khajane-2 website and give the DRO officer the payment challan)

Day 18:

Pick up the POA at the DRO at around 10 am (after the DRO seal and sign). Visit the bank to collect property documents that same day. Bring the following documents to the bank

  • Original POA
  • Self-attested identification proofs (both executant and POA holder)

After validating the aforementioned documents, bank staff gives the original property documents

Additionally, the bank staff will hand over the Discharge Deed/ Reconveyance Deed to remove home loan lien registered in sub-registrar office.

How do I cancel a Power of Attorney from outside India?

  • Power of Attorney (POA)
  • The principal is the person who grants the POA
  • The agent is the person who receives the POA

We can cancel a Power of Attorney from outside India and we explained the detailed procedure below


The principal cancels the POA in various circumstances. Below are few:

  • Lost of Trust
  • Change in relationship
  • Change in requirement or purpose
  • When the purpose of the POA has come to an end
  • When the agent becomes insolvent or unsound mind
  • Gross mismanagement on agent’s part
  • Agent breaches the contract terms or acts beyond his/her scope of power

Procedure to cancel the Power of Attorney from abroad:

  • Draft the “Revocation of POA”
  • Print the draft on A4-size paper
  • Principal Sign the “Revocation of POA”
  • Attest the “Revocation of POA” from notary or consulate in the country you reside
  • Send the “Revocation of POA” to India

In India, your representative submits the below documents to Registrar’s Office for adjudication

  • Revocation of POA
  • Photocopy of POA (which you executed earlier and want to cancel now)
  • Photocopy of principal’s and Agent’s ID proof

The registrar’s office verifies the above documents and your representative pays the required stamp duty

The registrar’s office adjudicates the “Revocation of POA”

The Registrar’s office hands back the original “Revocation of POA” and retains the photocopy

This completes the procedure.


Let me share my experience of canceling the POA:

My client lives in Texas, USA. He owns a villa in Bangalore and he wants to sell his Villa.

Due to geographical and time constraints, my client could not look after the sale process. He granted General Power of Attorney (GPA) to his brother in India so his brother could look after the sale proceeds on his behalf.

Refer to the below GPA

After two months of exploring the market, we found a first-time home buyer whose consideration is Rs. 1.2 Cr. However, the buyer was not interested in buying through GPA. Because the buyer wants the actual owner to sign the sale deed and present biometric thumb impression in sub-registrar office for registration

The deal seemed lucrative, so we obliged the buyer’s request. We canceled the above GPA as the seller will come to India for deed registration

We followed the below procedure to cancel our GPA:

  • Drafted the “Revocation of GPA” in Word document
  • We emailed the draft to our client (who is in Texas, USA)
  • My client in Texas took the printout and signed
  • My client got notary attestation in “Revocation of GPA” in Texas
  • My client couriered the “Revocation of GPA” to India

In India, we submitted the following documents to the District registrar’s office for adjudication

  • Original “Revocation of GPA” (which came from Texas, USA)
  • Photocopy of GPA (which we executed 2 months ago)
  • Printout of Principal and agent ID proofs
  • Request letter addressing to District Registrar for adjudication of “Revocation of GPA”
  • The staff in the District registrar verified the documents and accepted them for adjudication
  • We paid the Stamp Duty of Rs. 500

Within the same day evening, our “Revocation of GPA” was Adjudicated and handed to us. Refer to below image

We shared the revocation copy with the buyer for his reference, Also we published it in two newspapers, one in Kannada and another in English language paper

This completes the procedure of canceling our GPA

How to make Power Of Attorney (POA) in USA for India?

A power of attorney (POA) is a legal document giving one person (the agent) the power to act for another person, the principal. The agent can have broad legal authority or limited authority to make decisions about the principal’s property, finances, or medical care.

Below is the procedure to make Power of Attorney (POA) in USA for transactions in India.

Step 3: Meet the Indian consulate or notary public near you.
Principal should sign the POA in front of notary. Notary seal and signs the POA.

Step 4: Send the POA to India through reputed shipping partner like Fedex/DHL or hand carry through personal source

Step 5: The Agent in India should prepare the Request letter, addressed to the District Registrar office (DRO).

Step 6: Pay the stamp duty.

• Request letter
• Stamp duty Challan
• ID proofs of principal & Agent (Preferably Aadhar or passport copy)

NRI from Australia wants to sell property in India, is general power of attorney is possible to only blood relatives?

As an NRI from Australia sells property in India, General power of attorney (GPA) is possible for blood relatives and non-blood relatives but we have few consequences when giving GPA to non-blood relative


NRI Buying:

As an NRI, when you buy a property in India, you can give GPA to anyone including blood and non-blood relatives.

Blood relatives are: Father, Mother, brother, sister, husband, wife, children,

Non-blood relatives are: cousins, friends, colleagues, advocates, or broker

The stamp duty for GPA adjudication in India is just Rs. 500/-per executant (for buying property)


NRI Selling:

As an NRI, when you sell a property in India, you can give a GPA to anyone including blood and non-blood relatives. The Stamp Duty for blood and non-blood relatives is different:

  • The stamp duty for blood relatives is Rs. 500
  • The stamp duty for non-blood relatives is 5% of selling price or guidance value, whichever is higher

For example: Let’s consider that you want to sell a 3BHK flat in Bangalore India. The selling price is Rs. 80 lakhs and the guidance value is Rs. 55 lakh

If you give GPA to blood relative, the stamp duty is Rs. 500 irrespective of selling price

If you give a GPA to non-blood relative, the stamp duty is Rs. 80 lakh * 5% = 4,00,000/-. This Stamp Duty is paid at the time of GPA adjudication in India.

We suggest you issue GPA to blood relatives to avoid hefty stamp duty and also blood relative considered trustworthy. OR you can issue Speical Power of Attorney (SPOA) to anyone, the stamp duty for SPOA is Rs.500 per executant for selling property

Can an NRI give Power of Attorney to her father-in-law to sell her property in Bangalore?

As an NRI, when you buy a property, you can give Power of Attorney (POA) to any trusted sources in India including your father, mother, brother, sister, in-laws, friends, and colleagues. The Stamp Duty for POA is just Rs. 500 (for buying a property)

When you sell a property, you have to give POA to your blood relative, the blood relative includes your father, mother, brother, sister, husband, and your children. In-law doesn’t comes under blood relative category, which means your father-in-law doesn’t come under blood relative category.  The Stamp Duty for blood relative is Rs. 500 (for selling a property)

For non-blood relatives, You can give POA to your father-in-law but you have to pay 5%  stamp duty at the time of POA adjudication. Stamp duty is based on the market value or selling price of the property, whichever is higher

For example: Your property value is Rs. 50 Lakh.

  • The stamp Duty is 5%X50 lakh = 2,50,000
  • POA Adjudication fee is paid on Khajane2 website
  • Government charges are based on government guidance value or selling price, whichever is higher.

Below is a real example of a similar situation.

Husband and wife, jointly own a property in Bangalore. Both live in Canada and cannot travel to India to register the property.

Both husband and wife decided to give POA to father (father to husband and In-law to wife) so the husband is blood-related to father and wife is not blood-related. In such a situation, we need to pay 50% of government charges

My client was unwilling to pay 2.5% as Stamp Duty, hence we planned to execute the POA between wife and husband to avoid a hefty Stamp Duty.

The wife gave POA to her husband, We executed the POA in Canada,  notarized it in Canada, and adjudicated the POA in India. We incurred the stamp duty of Rs. 200 (edit on 11th Nov 2024: Stamp duty revised to Rs. 500)

The husband traveled to India and sold the property using the below POA

What is the validity of a general power of attorney executed outside India?

General Power of Attorney (GPA) remains valid till the life of principal or attorney, within their lifetime, one can revoke the GPA at any time.

GPA can be executed with duration validity, For example: for a period of 1 year, 5 year, or till the specific transaction or legal task of which GPA was executed. GPA is revoked when the specified duration, transaction or legal task is accomplished.


Below is the procedure to execute a valid GPA

  • Draft the GPA in Word format (the format is different for buying, selling, and bank matters)
  • Print the draft on A4 size paper,
  • Get the GPA attested by local notary or Indian consulate in your country
  • Send the GPA to your Attorney holder in India through a reputed shipping partner (Ex: Fedex, DHL, or your source traveling to India)
  • Your attorney holder in India should adjudicate the GPA in the District registrar’s office, in the judication of property located.

This completes the procedure to execute GPA in a foreign country for property or bank matters in India.
