Can a Partitioned Property Be Gifted?

Yes, a partitioned property can be gifted. However, before proceeding, ensure that the Khata and property tax records are updated in the donor’s name.

Let me share a real-life example of a similar situation.

Case Study: Mr. Srinivasan’s Property Partition

Mr. Srinivasan owned two properties in Bangalore, totaling approximately 3,000 square feet. On July 16, 2004, he executed a partition deed, distributing the properties among his three sons: Vijaykumar, Vinod Kumar, and Shiva Kumar.

As per the registered partition deed, SCHEDULE – C was allotted to Mr. Vinod Kumar (highlighted in the image of the partition deed below).

Updating Property Records

  1. Khata Transfer: Mr. Vinod Kumar successfully transferred the Khata from his father’s name to his own. The encircled section in the Khata document confirms the update.
  2. Property Tax Update: He also updated the property tax records, replacing his father’s name with his own. The updated name is highlighted in the property tax receipt below.

Gifting the Property

Mr. Vinod Kumar decided to gift this property to his daughter. To complete the process, we paid the following government fees and registered the Gift Deed at the sub-registrar’s office:

  • Stamp Duty: ₹5,000
  • Registration Fee: ₹1,000
  • Scanning Fee: ₹35 per page

The registered Gift Deed, with Mr. Vinod Kumar’s name encircled, is shown in the image below.
