How to Gift Immovable Property from Husband to Wife

A husband can legally gift immovable property to his wife by executing a Gift Deed. The process is straightforward and involves three key steps:

  • Drafting the Gift Deed
  • Appointment & Government Fee Payment
  • Registration at the Sub-Registrar’s Office

Below, we explain each step in detail:

1. DRAFTING THE GIFT DEED

The first step is to prepare a Gift Deed document. This is a legal instrument that transfers ownership of the property from the husband to the wife without any monetary exchange.

  • Draft the Gift Deed using standard legal language (see sample format below).
  • The draft must clearly specify the details of the donor (husband), donee (wife), property particulars, and the terms of the gift.
  • Once finalized, print the draft on document paper

Next, an application must be submitted at the Sub-Registrar’s Office for the registration of the Gift Deed. The following documents are required:

Required Documents:

  • Gift Deed draft (printed on document paper)
  • Husband’s registered property document (e.g: sale deed)
  • Latest property tax paid receipt
  • eKhata certificate
  • Aadhaar cards of husband, wife, and two witnesses

Applicable Government Fees in Karnataka:

  • Stamp Duty: ₹5,000
  • Registration Fee: ₹1,000
  • Scanning Fee: ₹35 per page

Once the documents are ready and the fees are paid, you can book a registration slot online
