A husband can legally gift immovable property to his wife by executing a Gift Deed. The process is straightforward and involves three key steps:
- Drafting the Gift Deed
- Appointment & Government Fee Payment
- Registration at the Sub-Registrar’s Office
Below, we explain each step in detail:
1. DRAFTING THE GIFT DEED
The first step is to prepare a Gift Deed document. This is a legal instrument that transfers ownership of the property from the husband to the wife without any monetary exchange.
- Draft the Gift Deed using standard legal language (see sample format below).
- The draft must clearly specify the details of the donor (husband), donee (wife), property particulars, and the terms of the gift.
- Once finalized, print the draft on document paper

- APPOINTMENT & PAYMENT OF GOVERNMENT FEES
Next, an application must be submitted at the Sub-Registrar’s Office for the registration of the Gift Deed. The following documents are required:
Required Documents:
- Gift Deed draft (printed on document paper)
- Husband’s registered property document (e.g: sale deed)
- Latest property tax paid receipt
- eKhata certificate
- Aadhaar cards of husband, wife, and two witnesses
Applicable Government Fees in Karnataka:
- Stamp Duty: ₹5,000
- Registration Fee: ₹1,000
- Scanning Fee: ₹35 per page

- REGISTRATION OF GIFT DEED
On the date of the appointment, visit the Sub-Registrar’s Office with the following:
Documents to Carry:
- Printed and signed Gift Deed
- Aadhaar cards of husband and wife
- Application summary report
- Payment receipt of government fees
All parties — husband, wife, and two witnesses — must be present to:
- Sign the deed
- Provide thumb impressions
- Complete biometric verification and photo capture
- Authenticate identity via OTP verification
Once the process is complete, the registered Gift Deed will be handed over.

IMPORTANT NOTES:
- If the property is solely owned by the husband, he may gift it entirely to his wife through a Gift Deed.
- If the property is jointly owned, the husband may transfer his share to his wife by executing a Release Deed
