How Can an OCI Living in the USA Transfer a Property in Bangalore from Mother’s Name to Their Own?

If you are an Overseas Citizen of India (OCI) residing in the USA and your mother owns a property in Bangalore, you can transfer the property to your name through a Gift Deed, which is one of the simplest and most cost-effective methods for family transfers.


GIFT DEED TRANSFER

Your mother can transfer the property to you, without any monetary consideration, by executing a Gift Deed. The approximate costs for registering a Gift Deed in Bangalore are as follows:

  • Stamp Duty: Rs. 5000
  • Registration: Rs 1000
  • Scanning Rs. 50 per page (Rs 500 approx.10 pages)

Total estimated cost Rs. 6,500 (Approx.)


REQUIRED DOCUMENTS

  1. The original registered deed of how your mother acquired the property
  2. Mother’s Aadhaar Card
  3. Son’s PAN Card (Your PAN)
  4. Latest Property Tax Receipt
  5. eKhata certificate

For registration, you, your mother, and two witnesses must be physically present at the sub-registrar’s office.


IF YOU CANNOT TRAVEL TO INDIA

If you are unable to travel to India for the registration of the Gift Deed, you may execute a Power of Attorney (POA) from the USA, authorizing your mother to sign the Gift Deed on your behalf.

  • In this case, your mother will sign the Gift Deed as the Donor (on her own behalf) and also as the Donee (on your behalf as per POA).

STEPS TO REGISTER A GIFT DEED IN BANGALORE

  • Execute a Power of Attorney (if applicable)
  • Draft the Gift Deed (Word document)
  • Print the Gift Deed draft on document paper and sign at all pages
  • Submit an application through Kaveri Online Services
  • Pay stamp duty and registration fee
  • Book an appointment for registration
  • Visit the sub-registrar’s office with required parties and register the Gift Deed

POST REGISTRATION: KHATA MUTATION

After the Gift Deed is registered, the Khata mutation from your mother’s name to your name is processed automatically. You will only need to pay a mutation fee of Rs. 650 through the eAasthi portal to download the updated eKhata reflecting your ownership.


IMPORTANT NOTES

  • If the property is self-acquired by your mother, she can gift it to you freely.
  • If the property is inherited by your mother, then all legal heirs (you, your siblings, and your father) hold rights to the property. In this scenario, you may need to execute and register a Relinquishment Deed with the consent of all legal heirs to obtain clear title in your name.
