Is it possible to get the sale deed copy of a property that I sold few years?

Yes, it is possible to get the Sale Deed copy of a property that you sold few years ago,

Based on your name, extract the encumbrance certificate (EC).

Under your name, two transaction details reflectes in EC, they are the one you purchased and the other one you sold.

Extract the sale deed based on the registration number mentioned in EC.

For Example:

My name is Navaneeth. On 21–09-2012, I purchased a 2BHK flat in Bangalore. On 26–09-2022, I sold my 2BHK flat

One year later, I need the sale deed copy to file my income tax returns. I contacted my buyer to share the sale deed copy, but buyer already deposited the sale deed in bank for exchange of loan so we don’t have access to sale deed now. Also, I don’t remember the registration number

What happens if original deed is lost? Property located in Karnataka

Let me narrate my experience for your better understanding:

I registered the sale deed on 7th April 2018.

In Jan 2022, during transit, I lost all my property documents including sale deed, encumbrance certificate, Khata and tax-paid receipt. Even I don’t remember the registration number of my sale deed.

In Karnataka, properties registered after 2004 are recorded digitally and saved scan copy of property documents in Kaveri Online service.

My property is registered after 2004 so based on my name (Sheena) and my property address, I searched my Encumbrance Certificate on Kaveri Online Services. Through search report, we found the property registration number and encircled the registration number in below image,

Step 1: Based on the above Registration number, we extracted the certified copy of sale deed on Kaveri Online Service. Below is the image of certified copy (posted only 1st page of certified copy)

Step 2: To file FIR in police station, we need to prepare an affidavit so we prepared the below affidavit stating that we lost the original sale deed

Step 3: Visited the police station and gave the below written complain

Filed the below FIR

Step 4: Published in two newspapers, one in English newspaper and another in local language newspaper, Below are the images of publication.

We wrote a letter to Area revenue office (ARO) to find our property tax application number and khata number based on our above sale deed certified copy.

In 20 working days, we received our property tax application number and new Khata extract from BBMP.

By now, we have almost all the documents, listed below

  • Sale Deed certified copy
  • Encumbrance Certificate
  • Property tax receipt
  • Khata
  • Affidavit
  • FIR
  • Newspaper publishing clip

What is certified copy? How to get certified copy of registered mortgage deed online in Karnataka?

A certified copy is a duplicate of an original document that is certified as a true copy by the officer having custody of the original.

To get the certified copy of mortgage deed, should have registration details

The mortgage registration details looks like SHV-1-12345-2014-15

Below is the abbreviation of registration details

  • SHV – Shivajinagar sub-registrar office in Bangalore (every sub-registrar office have short name and it is part of registration details. I registered the mortgage in shivajinagar sub-registrar office so SHV is part of my registration details)
  • 1 – Book number
  • 12345 – Document number (or registration number)
  • 2014-15 – Year of registration

Follow the below steps to download the mortgage deed online.

Step 1: Open the website Kaveri Online Service, Here is the link.

If you haven’t registered in Kaveri Online service, register by click on “Register as new user”, refer to below image in circle.

Name, Age, address, email, mobile number and date of birth information required to register.

Step 2: Click on “Online CC”. Refer to below image in circle.

Based on my registration details SHV-1-12345-2014-15, I filled application form

  • Document Type: Select “Document Registration” from dropdown list
  • District: Selected “Bengaluru Urban” from dropdown list
  • Sub Registrar Office: I registered the deed in Shivajinagar sub-registrar office so I selected “Shivajinagar” from dropdown list
  • Document Number: Type your document number, I types as :12345”
  • Book Type: Select “Book-1’ from dropdown list
  • Year Of Registration: I registered in the year of 2014-15, so I selected “2014-15” from dropdown list

Click on “Search”.

The carbon copy appears. Refer to below image.

Crosscheck the information and click on “Proceed”.

Step 3: The application fee is Rs. 100, click on “Click for payment” to complete the payment.

Step 4: Click on “Send for E-sign” to complete the aadhar based OTP authentication. Refer to below image in circle.

Click on “Submit”.

Application details sent through sms and email. Refer to below SMS for your reference.

Within 7 working days, you will receive another SMS that your application is signed by SR (sub-registrar) and uploaded. Below SMS for your reference.

Step 5: Open the Kaveri Online website

Login using user name, password and OTP

Click on “Saved Applications”. Refer to below image in circle.

In-Service Type, Select “Online CC Application” from dropdown list.

Click on the View application.

Click on “Download Signed CC Report”. Refer to below image.

What is the procedure if we have lost the sale deed of our property? How do I get the original sale deed again?

Once the original sale deed is lost, cannot get the original sale deed until your find the lost sale deed. However, you can obtain certified copy of sale deed from sub-registrar office (SRO). A certified copy is not the original sale deed but the substitute for the original sale deed.

Certified copy of sale deed from SRO can be used for mortgage, subject to submission of following documents to bank

  • Certified copy of sale deed, attested by SRO
  • Identity proof (Aadhaar or passport, ID proof name should match the names in certified copy of sale deed)
  • Police complain letter
  • Newspaper clip that you lost the original sale deed (One from local language and another from English language newspaper)

Getting certified copy from SRO is quite simple and easy. You should have any one of the below details to file certified copy application.

  • Property registration number
  • Encumbrance certificate

My current home Sale Deed and the online sale deed available in Kaveri online are different. How to correct this

Make sure that you made your entries are correct in Kaveri Online Services, especially the document number, book name, name of the sub-registrar office and year of registration.

If still wrong certified copy popup instead actual copy, contact your sub-registrar office to correct the same.

Carry the following documents to sub-registrar office where you registered the property

  • Sale Deed (original)
  • Latest EC
  • Latest tax-paid receipt

In Karnataka, we can get the certified copy of sale deed online only if the property is registered after 2004.

There is no online provision to obtain the certified copy if property is registered before 2004.

What is a parent deed, and how do you obtain another copy of a lost parent deed for my land?

Parent deed is also called as Mother Deed. The parent deed traces history of ownership.

Ownership of property changes hands through a series of transactions. It is very important to trace the ownership of a property, especially when it is either being purchased, offered as a security, or court case.

Parent Deed determines ownership of a property. Tracing ownership should always begin with scrutiny of the earliest document recorded. If such documents are not made available, certified copies have to be obtained from the registering authorities. This process should not be ignored. Earlier documents are called Parent or Mother documents

Property transaction changes hands through various modes like sale, gift, partition, and inheritance. Each change of ownership has to be traced with the help of a transfer document. The sequence should be in chronological order, continuous and unbroken. Any missing link has to be carefully scrutinized by referring to the records at the registering offices. The transfer flow should be traced.

Please note that partition deed, gift deed, release deed, settlement deed, and power of attorney are not parent documents
