How do I get a copy of a registered will from a sub-registrar’s office if the testator is dead?

If the Testator is no more, we can submit the following documents to the same sub-registrar office where the WILL was registered

  • Testator Death certificate
  • Applicant ID proof (Preferably Aadhaar)
  • FORM 22 (Application Form)

The fee for certified copy is around Rs.50, payable in the sub-registrar office’s name. The sub-registrar office searches and provides the certified copy within 7 working days


Let me share my similar experience for your better understanding:

My client Mr.Shyam is 78 years old and lives in Mumbai. His son Mr. Rohit registered a WILL in Indiranagar sub-registrar office in Bangalore, in the year 2023.

In Jan 2024, Mr. Rohit died. After Mr. Rohit decease, his father Mr. Shyam was not able to find the WILL and he didn’t know the registration number as well

Mr.Shyam e-mailed us the following documents:

  • Rohit’s Death certificate
  • Shyam’s Aadhaar
  • Scanned copy of FORM 22

We submitted the above documents to Indiranagar sub-registrar office in Bangalore. We paid the government fee of Rs. 200.

In 3 working days, we received the below WILL-certified copy

 

NOTE:

  • WILL is a private document, stored in Book No. 3. The Book No. 3 documents are not accessible to public. This means WILL documents are inaccessible in public records like encumbrance certificates (EC). WILL registration data is not inaccessible in EC search
  • We cannot download the WILL-certified copy online even if we have the registration number. Refer to the reason mentioned in below image

  • We can get the WILL-Certified copy only in the same sub-registrar office where the WILL was registered

Is a registered will reflectable in EC (Encumbrance Certificate) upon doing a search?

No, Registered WILL doesn’t reflect in EC (Encumbrance Certificate)

Because in sub-registrar office, WILL is stored in Book No. 3, the Book No. 3 is not meant for public record.

We highlighted the Book No. 3 in below WILL (refer to arrow mark)

Though the register WILL doesn’t reflect in EC, but we can obtain certified copy of WILL. The document number of WILL is mandatory to extract certified copy

  • If WILL registered after 2004, we can download the certified copy online. Testator ID proof is not mandatory to download online
  • If WILL registered before 2004, we should apply in sub-registrar office where the WILL was registered. Testator ID proof is mandatory to submit along with application

Note: 

  • Testator means a person who has made a WILL
  • Apart from Book No. 3,  Book No. 4 also doesn’t reflect in EC.
  • Book No. 4 meant for Power of Attorney registration. Power of attorney doesn’t reflect in EC. Just FYI

How do I get certified copy of WILL online in Karnataka?

We can download the certified copy of WILL online, follow the below steps

Step 1: We should have the registration number, the registration number looks like SRI-3–00XXX-2016–17, the abbreviation of registration number as follows:

  • SRI : Short name of Srirampuram sub-registrar office
  • 3 : WILL is stored in book number 3
  • 00XXX : five digit document number
  • 2016–17 : Year of registration

We will download the certified copy based on the above registration number


Step 2: Open the Kaveri Online Services, here is the link https://kaveri.karnataka.gov.in/landing-page . Login using username and password, we highlighted the login option in below image

After login, click on Start a New Application, refer to below image

Click on CERTIFIED COPY – (ONLINE CC). Refer to below image

In Prerequisite for CC, click on Continue. Refer to below image

In property details, enter the following options

  • DOCUMENT TYPE : Document Registration
  • DISTRICT : Rajajinagar (the WILL was registered in Srirampuram sub-registrar office which is in Rajajinagar district Jurisdiction )
  • SUB REGISTER OFFICE : Srirampuram (name of the sub-registrar office where the WILL was registered)
  • BOOK TYPE : Book -3
  • DOCUMENT NUMBER : 00XXX (enter five digit document number, we mentioned about this in step 1)
  • YEAR OF REGISTRATION: 2016–17 (select the year of WILL registration)

Click on Search, Refer to below image

Check the terms & conditions and click on Proceed, refer to below image


 

The government fee is Rs. 110 including application fee, search fee and Stamp Duty (cost is variable, based on number of pages)

Click on the Make Payment. Refer to below image

 

We made the payment through UPI

Click on E-Sign and do the E-Sign based on the Aadhaar number. Refer to below images

Click on Submit, Refer to below image


 

Step 3: After three days of submitting the above application, we received SMS notification that signed certified copy is ready for download.

Login to Kaveri online Service and clicked on Download Signed CC . Refer to below image

Signed certified copy downloads in PDF. Below is the image of my Signed certified copy

Certified copy has QR code in all pages, we highlighted the same in above image

Certified copy has Sub-registrar office sign at last page, we highlighted in below image


 

Note:

  • WILL can be registered or unregistered, we can download only the registered WILL online in Kaveri Online Services
  • We can download certified copy in Kaveri Online Services only if WILL was registered after 2004. If the WILL was registered before 2004, we should apply certified copy offline in respective sub-registrar office where the WILL was registered. the application fee is around Rs.10 and lead time is around 5–7 working days
  • Testator or legal heir ID proof is mandatory if we apply certified copy in sub-registrar office.

Edit on 8th Nov 2024: We used to download WILL certified copy online, but now the WILL certified copy is not available online. we need to submit an application offline in sub-registrar office.
