How to Transfer a Joint Ownership Property to a Single Owner

If you are looking to transfer a jointly owned property to a single owner, the most common and legally recognized method is through a Release Deed.


EXAMPLE SCENARIO:

In January 2015, a husband and wife jointly purchased an apartment in Bangalore from a builder. The Sale Deed clearly reflects this joint ownership:

The first page of the Sale Deed contains the seller’s details.

The second page shows the buyers’ details, listing both the husband and wife as co-owners.

This joint ownership is also reflected in the Encumbrance Certificate (EC), where both names are recorded as owners of the property. (Refer to the arrow mark in the EC image below.)


TRANSFER OF OWNERSHIP:

In January 2024, the husband decided to relinquish his share in the property and transfer it to his wife, thereby making her the sole owner of the property. This transfer was executed through a Release Deed.

STEPS FOLLOWED TO REGISTER THE RELEASE DEED:

  • Drafting
    The Release Deed was prepared in a Word document, clearly stating the intention of the husband (Releasor) to release his share to the wife (Releasee).
  • Online Submission
    The draft Release Deed was submitted via the Kaveri Online Services portal (applicable in Karnataka).
  • Payment of Government Fee
    A government fee of Rs. 6,350 was paid, which includes Stamp Duty, Registration, and Scanning Fees.
  • Appointment Booking
    An appointment was scheduled for the registration of the deed at the respective Sub-Registrar’s Office.
  • Registration
    The Release Deed was officially registered. As per the deed, the husband is the Releasor, and the wife is the Releasee. Refer to below registered Deed

Following the registration, the Encumbrance Certificate was updated to reflect the change. Now, only the wife’s name appears as the owner of the property. (Refer to the arrow mark in the updated EC image.)


CONCLUSION:

By executing a Release Deed, the joint ownership of the property was successfully transferred to single ownership. The wife is now the absolute and sole owner of the property.

How do I register Relinquishment Deed in Kaveri Online Services in Karnataka?

Relinquishment deed is a legal document that transfers the ownership of a property from one person to another. Relinquishment deed is commonly used in cases where a co-owner or a legal heir wishes to transfer their share of the property to another co-owner or legal heir.

Relinquishment deed may be made for a consideration or even without consideration. Relinquishment deed must be signed by releasor, releasee and two witnesses.

  • Releasor : is the person who agrees to release his/her share in property
  • Releasee : is the person who claims the share in property

Relinquishment deed should register in sub-registrar office


Documents required to register Relinquishment Deed:

  • Deed (of how the Releasor acquired the property)
  • Tax receipt
  • Khata
  • PAN (of Releasor and Releasee)

Let me share my experience of registering Relinquishment Deed through Kaveri Online Services. For better understanding, lets set the context based on real example

Context: Father and daughter jointly owns a 3BHK flat in a multistory apartment . Out of love and affection, father releases his share in property to his daughter without consideration. Property locate in BBMP Jurisdiction, Bangalore.


Open the Kaveri Online Services website. Here is the link https://kaveri.karnataka.gov.in/landing-page

The home pages looks like below image

 

Click on Register (Name, Gender, email id and mobile number are required for registration). Login using your email id and password.

Refer the below image to locate Register and Login options (highlighted in arrow mark)

Below is the home page after login

Click on Start a New Application, refer to below image

Click on DOCUMENT REGISTRATION. refer to below image

Click Continue in Prerequisite for Document Registration. Refer to below image

In, Select Article and Sub Article, select the following options from dropdown list

  • NATURE OF DOCUMENT: Release deed
  • ARTICLE : Release
  • SUB ARTICLE : 45(b)(ii) -Release deed(WITHIN FAMILY DEFINITION) Immovable property situated in any of the combination limits such as BMRDA,BBMP,CMC,TMC,Town Panchayat and Grama Panchayat

Click on Continue. Refer to below image

Click on NON-AGRICULTURAL, Refer to below image

My property locate in BBMP Jurisdiction, selected Other (if property locate in Gram Panchayat Jurisdiction with e-khata, select e-Swathu). Refer to below image

 

Select the following options in dropdown list:

  • DISTRICT: Select BBMP from dropdown list
  • WARD NUMBER: Select your BBMP ward number. You can find your ward number in your property tax receipt
  • INDEX II: VILLAGE: Select village name in dropdown list
  • Zone: Property locate in BBMP jurisdiction, selected BBMP from dropdown
  • ROAD: My property locate in multi-storey apartment, selected my apartment name in dropdown list
  • PROPERTY NUMBER TYPE: Select Flat No in dropdown list
  • PRESENT PROPERTY NUMBER DETAILS: Enter Flat No.
  • Total Area (in Sq. Meter) : Enter super build-up area of flat

Click on Add More. Refer to below image

  • PROPERTY NUMBER TYPE: Select Survey No from dropdown
  • PRESENT PROPERTY NUMBER DETAILS : Enter the Survey No of the property

Click on Submit & Continue. Refer to below image

Based on the property input provided in above image, below is the outcome of the property (below is my property search). Refer to below image

Click on Save Property & Continue


In Property Schedule, enter the following information of property

  • Measurement of East To West and North To South (This is the mandatory section, I don’t have exact measurement, so I entered dot here to skip this part)
  • Part Area Measurement (enter super build-up area)
  • Boundaries of East, West, North, South (refer your releasor’s deed or relinquishment deed draft for this info)
  • Description of Property (refer your releasor’s deed or relinquishment deed draft for this info)

As per our context, father releasing his share in property to his daughter. One releasor and one releasee hence total number of executant is two. We selected 2 in Number of Executant, refer to below image

In Executant -1, enter the details of Releasor

  • Is Claimant: Select No
  • Individual or Organization: Select Individual
  • Followed by the details of name, mobile number, Relationship, Relative’s name, age, Gender, ID proof number, Address. Refer to below filled image

Click on Save Executant-1 And Go To Next

In Executant -2, enter the details of Releasee

  • Is Claimant: Select Yes
  • Individual or Organization: Select Individual
  • Followed by the details of name, mobile number, Relationship, Relative’s name, age, Gender, ID proof number, Address. Refer to below image

Click on Save Executant -2 and Click on Move to PRESENTER. Refer to below image


 

In Choose Presenter, select the presenter in dropdown list. (Presenter means the person who present the documents in sub-registrar office for registration)

I selected father name in dropdown list as presenter and click on Make Presenter. Refer to below image


IDENTIFIER means witness, we need to provide at least two witnesses

In IDENTIFIER -1, enter the details of 1st witness. The details includes Name, Age, Gender, Relationship, Relative’s Name and address.

In IDENTIFIES, select name of the person that whom the identifier -1 witnessing to. I selected father name in dropdown list.

Click on Save IDENTIFIER -1 And Go To Next

In IDENTIFIER -2, enter the details of 2nd witness. The details includes Name, Age, Gender, Relationship, Relative’s Name and address.

In IDENTIFIES, select name of the person that whom the identifier -2 witnessing to. I selected daughter name in dropdown list.

Click on Save and Continue


In, Allocate this schedule to: select the Releasee name in dropdown list. (I selected daughter’s name in dropdown list). Refer to below image

Click on Save and Continue


Relinquishment deed within family members and without consideration doesn’t require market value calculation. Refer to below image

Click on Continue


In Final fee calculation:

Click on Save and Continue


 

My Relinquishment Deed draft consist of 7 pages. Entered 7 in “Number of Pages”. Refer to below image

Below is the summary of application, cross verify the details before we submit the application. Its a scroll of 3–4 pages, we shared just 1st page below

At the bottom of page:

  • In, Upload Deed Document: Upload the Relinquishment Deed draft in PDF
  • In, Upload Annexures: Merge the ID proofs of Releasor & Releasee, tax receipt and khata in one PDF and upload
  • In, Date Of Execution : Select the current date
  • In, Select Sub-Registrar Office : Select name of the sub-registrar office from dropdown list. We have options of around 10–11 sub-registrar office, we can choose the one closest to your home or convenience to travel.
  • In, Declaration : Click the Declaration boxes

Click on Agree and Submit


In 2 days, our application was verified and received the status of Make Payment. Refer to below image

Made the payment through UPI. The government fee is Rs. 4,315. Booked the registration slot. Refer to below slot confirmation


On the day of registration: Releasor, Releasee and two witnesses were present in sub-registrar office

The presenter submitted following documents in registration counter

  • Printout of application summary report
  • Relinquishment Deed (to be registered)

Releasor and Releasee gave the thumb impression and webcam photo.

Releasor, Releasee and Two witnesses signed the Relinquishment Deed

Sub-registrar office scanned the Relinquishment deed for digital record and handed back to presenter

How to Register a Release Deed or Relinquishment Deed in India from Abroad: A Step-by-Step Guide with Real Case Reference

Release Deed or Relinquishment Deed is a legal document through which a person surrenders ownership of a property in favor of another person who is a co-owner of a property.

We cannot send release or Relinquishment deed from abroad because a deed must register in sub-registrar office in India. As an alternative, we can grant a power of attorney to co-owner to register deed on your behalf in India.

Let me give a real context for your better understanding:

Mrs.Padmavathi acquired 60-year-old ancestral property from her mother. The property measures 525 square feet of land and building on the land measures 350 square feet. The property is located in Basavanagudi, Bangalore

Since its an ancestral property, she doesn’t have registered deed but she has been paying property tax regularly, below is the latest tax-paid receipt

On 7th January 2022, Mrs. Padmavathi demised naturally from an alignment associated with aging. late Mrs. Padmavathi hava a daughter Mrs.Suma who is settled in USA and a Son Mr.Harish living in Bangalore

As per the Hindu Succession Act 1956, siblings Mrs.Suma and Mr.Harish acquired the property through a legitimate Khata transfer. The khata application was filed through Sakala Online Services, refer to the below khata image

Out of love and affection, Mrs.Suma wants to surrender her 50% of share in property to her brother Mr.Harish.

Mrs. Suma settled in USA and due to work commitments, she could not able to travel to India to register Release deed in sub-registrar office so she gave GPA to her brother Mr.Harish to register Release deed on her behalf.

Mrs.Suma followed the below steps to execute a GPA in USA:

Step 1: Drafted the GPA in word file

Step 2: Printed the GPA on A4 sheet paper

Step 3: Mrs.Suma signed the GPA in-front of notary public in USA

Notary public sealed and signed the GPA

Step 4: Mrs.Suma sent the GPA to her brother Mr. Harish in India via DHL Express

Step 5: Mr. Harish received in GPA in 5 days

Step 6: Mr.Harish Adjudicated the GPA in Basavanagudi District Registrar’s office.

GPA adjudication fee is Rs. 300 (Edit on 12th Nov 2024: the updated fee is Rs. 500). Below payment receipt for your reference

Mr.Harish followed below steps to register the release deed in Basavanagudi sub-registrar office in Bangalore.

Step 1: Drafted the Release deed in Word file

Step 2: Submitted an application on Kaveri Online Services. Our application is approved within 2 working days. We made the government fee payment and booked our registration slot

The following documents required to submit an application on Kaveri Online Servies

  • Khata
  • Property tax receipt
  • Release Deed draft
  • General Power of Attorney
  • Harish’s Aadhaar
  • Suma’s PAN
  • Two witnesses Aadhaar

Following are the Government fee

  • Stamp Duty: Rs. 5000
  • Registration Fee: Rs.1000
  • Scanning: Rs. 35 per page

Step 3: Print the Release Deed draft on document paper. The Releasor (GPA holder) and the Releasee sign all pages. Two witness signatures on the last page

Step 4: As per our registration slot, Mr.Harish carried the following documents to the Basavanagudi sub-registrar office for the Release deed registration

  • Application summary report
  • Release deed (to be registered)
  • General Power of Attorney (Shared the image above)
  • Government fee payment transaction receipt
  • Harish’s Aadhaar
  • Suma’s PAN
  • Two Witnesses and their Aadhaar

Step 5: In the sub-registrar, the presenter submitted the above listed documents at the registration counter

  • Harish gave the thumb impression and photo as GPA holder for the Releasor
  • Again, Mr. Harish gave thumb impression and photo as Releasee
  • Two witnesses gave thumb impressions and photo
