I’m going to divorce and the house is in both our names. My husband is giving the house to me. How do i transfer the property to my name only? is release Deed

You and your husband jointly own a property called Joint Property. Now, your husband wants to eliminate from the joint property and release his share to you, so you become 100% shareowner of the property.

To acquire 100% ownership, you and your husband must register a RELEASE DEED.

In a Release Deed, your husband is a Releasor, and you are a Releasee. To register a Release Deed, we need the following:

  • Registered Deed (that you and your husband jointly acquired the property)
  • Property tax receipt
  • eKhata
  • Husband and wife’s Aadhaar
  • Release Deed draft printed and signed (to be registered)
  • Two witnesses and their Aadhar

The Stamp Duty for release deed registration is Rs. 5000 and the registration fee is Rs. 1000. The total cost including cess and scanning fee totals around Rs. 7000/-

Register the Release Deed in a sub-registrar office. You, your husband, and two witnesses’ presence are mandatory in sub-registrar office for registration. The registered Release Deed looks like the below image


To remove your husband from the joint loan account, follow the below steps:

Novation: Contact your bank and request for novation. Novation is a declaration that transfers the home loan from joint applicants to single applicant. Your bank will provide the novation format

Proof of removal: Provide proof to bank why you want to remove your husband from joint loan account, proof such as divorce agreement

Proof of Income: Provide income proof to bank like salary slip or bank statement because you should prove your ability to repay the loan without co-borrower financial contribution or you can onboard another co-borrower to support your financial capability

Submit the following documents to the bank

  • Novation
  • Original Release Deed (that your husband released his share to you)
  • Copy of Divorce Agreement
  • Income proof

The bank will remove your husband from loan account


It’s important to remove your husband from joint loan account because after few years, once you repay the home loan, the bank will issue Discharge Deed in the name of loan applicants. In your case, the loan applicants are you and your husband. The loan applicant must register the Discharge Deed in registrar office to claim ownership from bank. Since you are separating from your husband, you should remove your husband from joint loan account so the bank will issue a Discharge Deed only in your name at the time of closing home loan. (if you didn’t remove your husband from the joint loan account, the bank would include your husband’s name in discharge deed and he must present for lien removal in sub-registrar office)

How do I transfer from joint ownership property to single ownership?

Through RELEASE DEED, we can acquire co-owner’s share and become single owner of the property


Let me give an example:

In January 2015, wife and husband jointly purchased a flat in Bangalore from a builder. Refer to below sale deed:

1st page consists of seller details

2nd page consists of buyers details (joint purchase of wife and husband).

In Encumbrance Certificate, Wife’s and husband’s names shown as owners of the property, Refer to arrow mark in below EC

In Jan 2024, Husband wants to release his share in property to his wife and make his wife single owner of the property. We decided to transfer husband’s share to wife through RELEASE DEED.


We followed below steps to register Release Deed:

Step 1: Drafted the Release Deed in word document

Step 2: Submitted the RELEASE DEED application online (Kaveri Online Services in Karnataka)

Step 3: Paid the government fee. The government fee is Rs. 6350/- (including Stamp Duty, Registration and scanning fees).

Step 4: Booked an appointment for registration

Step 5: Registered the Release deed in Sub-registrar office. Refer to below Release Deed that husband is the Releasor and Wife is the Releasee

In Encumbrance certificate, Only wife’s name shows as owner of the property. Refer to arrow mark in below image

It means that we successfully transferred Joint ownership to single owner that wife becomes absolute single owner of the property.

How to Register a Release Deed or Relinquishment Deed in India from Abroad: A Step-by-Step Guide with Real Case Reference

Release Deed or Relinquishment Deed is a legal document through which a person surrenders ownership of a property in favor of another person who is a co-owner of a property.

We cannot send release or Relinquishment deed from abroad because a deed must register in sub-registrar office in India. As an alternative, we can grant a power of attorney to co-owner to register deed on your behalf in India.

Let me give a real context for your better understanding:

Mrs.Padmavathi acquired 60-year-old ancestral property from her mother. The property measures 525 square feet of land and building on the land measures 350 square feet. The property is located in Basavanagudi, Bangalore

Since its an ancestral property, she doesn’t have registered deed but she has been paying property tax regularly, below is the latest tax-paid receipt

On 7th January 2022, Mrs. Padmavathi demised naturally from an alignment associated with aging. late Mrs. Padmavathi hava a daughter Mrs.Suma who is settled in USA and a Son Mr.Harish living in Bangalore

As per the Hindu Succession Act 1956, siblings Mrs.Suma and Mr.Harish acquired the property through a legitimate Khata transfer. The khata application was filed through Sakala Online Services, refer to the below khata image

Out of love and affection, Mrs.Suma wants to surrender her 50% of share in property to her brother Mr.Harish.

Mrs. Suma settled in USA and due to work commitments, she could not able to travel to India to register Release deed in sub-registrar office so she gave GPA to her brother Mr.Harish to register Release deed on her behalf.

Mrs.Suma followed the below steps to execute a GPA in USA:

Step 1: Drafted the GPA in word file

Step 2: Printed the GPA on A4 sheet paper

Step 3: Mrs.Suma signed the GPA in-front of notary public in USA

Notary public sealed and signed the GPA

Step 4: Mrs.Suma sent the GPA to her brother Mr. Harish in India via DHL Express

Step 5: Mr. Harish received in GPA in 5 days

Step 6: Mr.Harish Adjudicated the GPA in Basavanagudi District Registrar’s office.

GPA adjudication fee is Rs. 300 (Edit on 12th Nov 2024: the updated fee is Rs. 500). Below payment receipt for your reference

Mr.Harish followed below steps to register the release deed in Basavanagudi sub-registrar office in Bangalore.

Step 1: Drafted the Release deed in Word file

Step 2: Submitted an application on Kaveri Online Services. Our application is approved within 2 working days. We made the government fee payment and booked our registration slot

The following documents required to submit an application on Kaveri Online Servies

  • Khata
  • Property tax receipt
  • Release Deed draft
  • General Power of Attorney
  • Harish’s Aadhaar
  • Suma’s PAN
  • Two witnesses Aadhaar

Following are the Government fee

  • Stamp Duty: Rs. 5000
  • Registration Fee: Rs.1000
  • Scanning: Rs. 35 per page

Step 3: Print the Release Deed draft on document paper. The Releasor (GPA holder) and the Releasee sign all pages. Two witness signatures on the last page

Step 4: As per our registration slot, Mr.Harish carried the following documents to the Basavanagudi sub-registrar office for the Release deed registration

  • Application summary report
  • Release deed (to be registered)
  • General Power of Attorney (Shared the image above)
  • Government fee payment transaction receipt
  • Harish’s Aadhaar
  • Suma’s PAN
  • Two Witnesses and their Aadhaar

Step 5: In the sub-registrar, the presenter submitted the above listed documents at the registration counter

  • Harish gave the thumb impression and photo as GPA holder for the Releasor
  • Again, Mr. Harish gave thumb impression and photo as Releasee
  • Two witnesses gave thumb impressions and photo

For transactions where a blood relative releases property rights without any monetary exchange, the applicable charges are:
