I believe you are in Bangalore and you want to register a Power of Attorney (POA) in Bangalore before you return to abroad

Yes, you can register a POA in Bangalore and you need the following documents for registration

  • You sign the POA on all pages
  • Two witnesses’ signs on last page of POA

Step 3: Submit an application on Kaveri Online Services. Usually, the application is approved within 2–3 working days, pay the government fee and book the registration slot. In a separate blog, we wrote the detailed procedure to submit an application on Kaveri Online service, here is the link for your reference https://shorturl.at/vSHkk

Following are the documents required to submit an application on Kaveri Online Services

This completes the procedure to register POA in Bangalore

——————————–*************——————————

As an alternative option, we can execute a POA in abroad for property sale in India. But executing a POA in abroad costs more money, time and energy

For example: To register a POA in Bangalore cost less than Rs.1,500 and we can complete the entire process within 3 working days including drafting, appointment and registration in sub-registrar office

whereas, executing a POA in abroad cost more than Rs. 25,000 and at least 15 working days to complete the process including;

  • Drafting
  • Notary or consulate attention
  • Shipment to India
  • Adjudication in India

Additionally, you may need to travel for a long to get attention from notary or Indian consulate in abroad, especially in USA. Compared to India, it is not easy to make a power of attorney in abroad because of the high cost, time and effort. But still, we explain the procedure to execute a POA in abroad and you can consider this as your least possible option

Follow the below steps

Step 1: Draft a POA

Step 2: Print a POA draft on A4 size normal. Affix your passport-size photo

Step 3: Carry the following documents to notary public or consulate office in your county

  • POA
  • Passport or OCI
  • Your country citizenship proof (if applicable)

(Please cross-verify the required documents from the notary or consulate in your country)

Meet the notary public or consulate in your county and sign the POA in front of the concerned authority

Step 4: Courier the following documents to India

  • POA
  • A request letter addressing to District Registrar’s office, signed by you
  • Self-attested ID proof (Passport or OCI and PAN)

Step 5: Once the above-listed documents reach India, your POA holder or agent in India carry the following documents to District Registrar office

  • POA
  • Request letter
  • Your Self-attested ID Proofs
  • POA holder Aadhaar
  • Stamp Duty transaction receipt (The Stamp Duty is Rs. 500 per executant)

Step 6: The District Registrar’s office validates the above-listed documents and adjudicates the POA

This completes the procedure to execute a POA in abroad

How much time does it take to register a power of attorney in Karnataka?

Listing the time frame for your reference:

Day 1: Draft the Power of Attorney and Submit an application for registration

Day 2: Application approval, Make Payment, and slot booking

Day 3: Register the Power of Attorney in Sub-Registrar Office

Let me share a real example of registering a Power of Attorney (POA) and its time frame:

One of my clients approached us on 12th Sep 2024 to register Power of Attorney. On the same day, we drafted the POA and submitted an application on Kaveri Online Services, we highlighted the submission date in below summary report for your reference

On 13th Sep 2024 at around 10.30 am, our application was approved. We paid the government fee of Rs. 1480/- and got the registration slot on the same day at 2.30 pm. Refer to the below slot confirmation

We registered the Power of Attorney and we highlighted the date of registration in below image

We submitted the application on 12th Sep and completed the registration on 13th Sep. It means we completed the process within 2 working days

Approval and slot availability are major challenges, if we get a slot on the same day of approval, we can complete the process within 2 working days or it extends by one additional day

Is notarized Power Of Attorney valid for the execution of Sale Deed?

A notarized power of attorney is accepted for executing a Sale Deed if the Power of Attorney originates from abroad.

For Example: My client Mr.Arun and his wife Mrs. Shetal live in Australia. They jointly own a 2BHK flat in Bangalore. They decided to sell their flat using a Special Power of Attorney (SPOA)

They executed a “Special Power of Attorney” before Notary public in Australia. We highlighted the notary attestation in below SPOA for your reference

Using the above SPOA, we executed the Sale Deed at the sub registrar’s office in Bangalore. We highlighted the SPOA description in the Sale Deed below for your reference

Most of the sub-registrar offices do not accept the Power of Attorney executed before Notary public in India to register Sale Deed

For Example: one of my clients wishes to sell his property in Bangalore; he is a resident of Mysore. At the time of Sale Deed Registration, he will not be in India; instead, he will be in New Jersey, USA.

He granted his brother General Power of Attorney (GPA) to register a sale deed. Before departing the country, he executed the GPA on Rs. 200 non-judicial e-stamp paper before notary public in Mysore. Refer to the below GPA image

Now, the sub-registrar rejected the above GPA for the registration of Sale Deed. We highlighted the remark in the below image, which says “Not upload proper POA”. This means the sub-registrar requests us to upload the registered Power of Attorney.

My client would have registered the GPA at the sub-registrar office in Mysore instead of notary attestation, it would have cost him less than one thousand rupees to register a GPA in Mysore. Now we are working on the GPA in New Jersey, It is costing him $250 for notary and $50 for shipment which is around INR 25,000 in Indian currency.

My client would have avoided this hefty expense if he had registered the GPA instead of notary in India.

The Registered GPA looked like the image below; we registered this GPA for another client at JP Nagar sub-registrar office.

How to give Power of Attorney from abroad for closing home loan in India?

Once the home loan is paid off, the bank will send a loan closure letter to your registered email ID

The loan closure letter looks like the below image

In the same email, tell the bank that you live abroad and want to use a Power Of Attorney (POA) to collect property documents.

Please note the below mock response to the bank:

The bank will schedule a time to collect property documents and send an email with a POA format; typically, the bank provides an appointment within 15 working days

For example: The appointment date for document collection would be August 16th if the bank had issued an email confirming the appointment on August 1st.

Though the appointment date is August 16th, most banks allow for an additional 30 working days as buffer time

You should not panic if you miss the appointment date. In some countries, obtaining the POA within 15 working days can be challenging, which is why we mentioned the buffer period.

We are sharing the approximate timeline and process for carrying out the POA from abroad:

Day 1:

The bank emails a POA in Word document format. The POA’s majority of terms remain the same; we only need to add necessary details like;

  • Name, Age, Name of Father or spouse, Residential address, Loan account number and property schedule
  • Print the POA draft
  • Affix passport-size photo

Day 2:

Book an appointment with your country’s notary public. Most of the time, notary appointments are scheduled for the same day, however in the few USA and European countries, appointments must be scheduled at least three or seven days in advance.

Let’s consider the notary appointment takes, an average of 5 working days (from day 2 to day 6)

Day 6:

  • Meet the notary public and sign the POA in front of Notary
  • Notary attest and sign the POA

Once the notary is done, send the following documents to India that same day:

  • POA
  • Two sets of Self-attested identification proofs (Passport/OCI and PAN). One for adjudication in District Registrar’s office and another for document collection in bank in India

DHL/FedEx typically delivers packages in 5–7 business days. while the majority of other shipping firms require 10–15 working days

Let us consider an average of 10 working days for shipment (from day 6 to day 16)

Day 16:

The package arrives in India. let us consider the package arrived in the afternoon

Your POA holder (the person you granted the POA) in India opens the package, affixes his/her passport-size photo, and signs the POA

Print a copy of a letter requesting a POA adjudication from the district registrar’s office. Please review the sample request letter below

Print a copy of POA holder identification proof (Aadhaar and PAN)

Day 17:

The following documents are brought to the District Registrar’s office (DRO) by the POA holder:

  • POA (came from abroad)
  • Self-attested Identification proof (came from abroad)
  • Request letter
  • Identification proof of POA holder

The DRO personnel validates the aforementioned documents and requests payment of the stamp duty (in Karnataka, we pay Rs. 500 stamp duty on the Khajane-2 website and give the DRO officer the payment challan)

Day 18:

Pick up the POA at the DRO at around 10 am (after the DRO seal and sign). Visit the bank to collect property documents that same day. Bring the following documents to the bank

  • Original POA
  • Self-attested identification proofs (both executant and POA holder)

After validating the aforementioned documents, bank staff gives the original property documents

Additionally, the bank staff will hand over the Discharge Deed/ Reconveyance Deed to remove home loan lien registered in sub-registrar office.

We completed a Power of Attorney for one of my clients in Netherlands by following the above timeline and process. Please see the POA image below:

To remove the home loan lien, we also registered the Reconveyance Deed in the sub-registrar’s office. Please see the Reconveyance image below

We assist POA and line removal services. Please write to us pgnproperties@gmail.com or WhatsApp to +91-97424-79020

How do I cancel a Power of Attorney from outside India?

  • Power of Attorney (POA)
  • The principal is the person who grants the POA
  • The agent is the person who receives the POA

We can cancel a Power of Attorney from outside India and we explained the detailed procedure below

The principal cancels the POA in various circumstances. Below are few:

  • Lost of Trust
  • Change in relationship
  • Change in requirement or purpose
  • When the purpose of the POA has come to an end
  • When the agent becomes insolvent or unsound mind
  • Gross mismanagement on agent’s part
  • Agent breaches the contract terms or acts beyond his/her scope of power

Procedure to cancel the Power of Attorney from abroad:

  • Draft the “Revocation of POA”
  • Print the draft on A4-size paper
  • Principal Sign the “Revocation of POA”
  • Attest the “Revocation of POA” from notary or consulate in the country you reside
  • Send the “Revocation of POA” to India

In India, your representative submits the below documents to Registrar’s Office for adjudication

  • Revocation of POA
  • Photocopy of POA (which you executed earlier and want to cancel now)
  • Photocopy of principal’s and Agent’s ID proof

The registrar’s office verifies the above documents and your representative pays the required stamp duty

The registrar’s office adjudicates the “Revocation of POA”

The Registrar’s office hands back the original “Revocation of POA” and retains the photocopy

This completes the procedure.

Let me share my experience of canceling the POA:

My client lives in Texas, USA. He owns a villa in Bangalore and he wants to sell his Villa.

Due to geographical and time constraints, my client could not look after the sale process. He granted General Power of Attorney (GPA) to his brother in India so his brother could look after the sale proceeds on his behalf.

Refer to the below GPA

After two months of exploring the market, we found a first-time home buyer whose consideration is Rs. 1.2 Cr. However, the buyer was not interested in buying through GPA. Because the buyer wants the actual owner to sign the sale deed and present biometric thumb impression in sub-registrar office for registration

The deal seemed lucrative, so we obliged the buyer’s request. We canceled the above GPA as the seller will come to India for deed registration

We followed the below procedure to cancel our GPA:

  • Drafted the “Revocation of GPA” in Word document
  • We emailed the draft to our client (who is in Texas, USA)
  • My client in Texas took the printout and signed
  • My client got notary attestation in “Revocation of GPA” in Texas
  • My client couriered the “Revocation of GPA” to India

In India, we submitted the following documents to the District registrar’s office for adjudication

  • Original “Revocation of GPA” (which came from Texas, USA)
  • Photocopy of GPA (which we executed 2 months ago)
  • Printout of Principal and agent ID proofs
  • Request letter addressing to District Registrar for adjudication of “Revocation of GPA”
  • The staff in the District registrar verified the documents and accepted them for adjudication
  • We paid the Stamp Duty of Rs. 500

Within the same day evening, our “Revocation of GPA” was Adjudicated and handed to us. Refer to below image

We shared the revocation copy with the buyer for his reference, Also we published it in two newspapers, one in Kannada and another in English language paper

This completes the procedure of canceling our GPA

What is the procedure for giving a power of attorney for a property in India?

The power of attorney (POA) execution is quite different for NRIs and Indian residents.

Let me start with NRIs resident:

NRIs don’t have to be present physically for registration of property for buying, selling, or managing in India.

NRIs can issue true and lawful power of attorney in favor of his/her family member, relative, friend, colleague, or agent. we should make sure that attorney holder is truthful and reliable to you.

Below are the steps to execute power of attorney

Step 1: Prepare the draft in Word format

Step 2: Print draft on A4 size paper

Step 3: NRI should sign POA in front of Indian Consulate Officer or notary public in your country. Should sign at bottom of all pages and witness has to sign at witness section.

Step 4: Courier the POA to your true and lawful attorney to India.

Step 5: Attorney holder in India should adjudicate the POA in District Registrar’s office, in the judication of where the property is located.

Please note, as an NRI, your presence is not mandatory to register the property but attestation from Indian consulate at your country is very much mandatory.

NRI GPA looks like below image:

For Indian residents: (executant or attorney living at different places in India)

Step 1: The Executant should prepare the draft in Word format

Step 2: Submit an application for registration in sub-registrar office + application must be approved within 2-3 working days + pay the government fee

  • Stamp Duty : Rs. 1000 per executant
  • Registration Fee is Rs. 200
  • Scanning Fee Rs. 35 per page

Step 3: Print the draft on document paper

Step 4: Executant carry the following things to sub-registrar office (SRO)

  • Printed POA
  • Application summary report and Payment receipt
  • ID proofs of executant, Preferably Aadhaar
  • Active mobile phone to receive OTP

Step 5: Executant signs the POA. In the registrar’s office, the officer takes your fingerprint and webcam photo to complete registration.

Step 6: Send the registered POA to your Attorney holder through courier or handover personally.

This completes the process of registering the POA if the executant and attorney live in different location within India. (say for example you live Karnataka and attorney live in Delhi).

For Indian residents: (Both executant and attorney living at same place in India)

Step 1: Prepare the draft in word format

Step 2: Submit an application for registration in sub-registrar office + application must be approved within 2-3 working days + pay the government fee

  • Stamp Duty: Rs. 1000 per executant
  • Registration Fee is Rs. 200
  • Scanning Fee Rs. 35 per page

Step 3: Print the draft on document paper

Step 4: Executant and Attorney carry the following things to sub-registrar office (SRO)

  • Printed POA
  • Application summary report and Payment receipt
  • ID proofs of executant & Attorney, Preferably Aadhaar
  • Active mobile phone to receive OTP

Step 5: Executant and Attorney signs the POA. In the registrar’s office, the officer takes fingerprint and webcam photo to complete registration.

This completed the registration procedure.

Can a Power of Attorney Holder Gift Property to themself?

Yes, a Power of Attorney (POA) holder can execute a Gift Deed to transfer property to themselves. However, this process requires careful drafting of the POA and adherence to legal procedures. In this blog, we’ll explain how this works, provide a real-life example, and outline the government charges involved in Karnataka.

Key Considerations for POA and Gift Deed Execution

When drafting a Power of Attorney (POA) for executing a Gift Deed, it’s crucial to:

  • Specify the Purpose: Clearly mention in the POA that it is being granted for the execution of a Gift Deed.
  • Include Donor and Donee Details: Provide detailed information about the donor (the person gifting the property) and the donee (the person receiving the property).

Real-Life Example: Gift Deed Execution Through POA

Here’s a real-life scenario to illustrate the process:

  • Case: Ms. Sumathi (mother) granted a General Power of Attorney (GPA)to her daughter, Ms. Shilpa.
  • Action: Using the GPA, Ms. Shilpa executed a Gift Deedto transfer the property to herself. In this case, Ms. Shilpa represented both the donor (her mother) and the donee (herself).

Government Charges for Gift Deed Execution in Karnataka

The government charges for executing a Gift Deed vary depending on whether the donee is a blood relative or a non-blood relative.

  1. For Blood Relatives

The following individuals are considered blood relatives:

  • Father
  • Mother
  • Brother
  • Sister
  • Wife
  • Son/Daughter

Government Charges:

  • Stamp Duty: Rs. 5,000
  • Registration Fee: Rs. 1,000
  • Cess: Rs. 500
  • Scanning Fee: Rs. 35 per page (approx. up 10-12 pages)
  1. For Non-Blood Relatives

Non-blood relatives include uncles, aunts, cousins, in-laws, nephews, friends, and colleagues. The charges are based on the property’s guidance value:

  • Stamp Duty: 5.1% of guidance value
  • Registration Fee: 1% of guidance value
  • Cess: 0.5% of guidance value
  • Scanning Fee: Rs. 35 per page

Note:

Guidance values can be checked online on the Kaveri Online Service or obtained at the information counter of the sub-registrar office.
