How to Execute a Power of Attorney from Japan to India for Property Purchase

If you are residing in Japan and planning to purchase property in India, executing a Power of Attorney (POA) is a practical solution to manage the transaction remotely. A Power of Attorney is a legal instrument that allows one individual (the Principal) to authorize another person (the Attorney or Agent) to act on their behalf in legal or financial matters.

In this blog, we share a real-life case study of one of our clients based in Osaka, Japan, who successfully executed a POA to purchase a retirement home in Devanahalli, Bangalore.

CASE BACKGROUND

Our client, an 80-year-old Indian citizen residing in Osaka, Japan, wanted to invest in a retirement home in India. After evaluating several options, she chose a flat in Devanahalli, Bangalore—an area known for its excellent connectivity, proximity to hospitals, and availability of premium housing at affordable rates.

Given her age and preference to avoid the complexities of on-ground execution, she appointed a trusted family friend in India as her Attorney. We assisted her in drafting and executing a Power of Attorney from Japan to India.

STEP-BY-STEP PROCEDURE TO EXECUTE POA FROM JAPAN TO INDIA

  1. Drafting the POA

We prepared the Power of Attorney document in standard format, clearly specifying the scope of powers granted to the Attorney.

  1. Sending the Draft

The document was emailed to the client in Japan. She printed the POA on A4-size paper and affixed her passport-size photograph on the last page.

  1. Document Checklist for Consulate Attestation

The client visited the Consulate General of India, Osaka-Kobe with the following documents:

  • Printed POA document
  • Original Indian Passport and one photocopy
  • Japan Residence Card and one photocopy
  1. In-Consulate Verification and Attestation
  • The consulate staff verified all submitted documents.
  • The client signed the POA in the presence of the consulate officer (signature must match the one in the passport).
  • A consular fee of JPY 2,800 (including tax) was paid in cash per POA document.
  • The Vice-Consul attested and signed the POA.
  • The consulate retained the photocopy and returned the original attested POA to the principal.
  1. Sending POA to India

The client couriered the following documents to the Attorney in India:

  • The attested POA document
  • Self-attested copy of her passport

The package was delivered via express courier within 3 business days.

  1. Execution in India
  • The Attorney affixed his passport-size photograph and signed the POA.
  • As the property is located in Devanahalli (which falls under Bangalore Rural jurisdiction), we got the POA adjudicated at the District Registrar’s Office – Rural Division, Rajajinagar.
  1. Adjudication Fee
  • Stamp Duty: Rs.200
  • Miscellaneous Charges: Rs.100
    Total (as of earlier): Rs.300
    Updated on 12th June 2025: The revised adjudication fee is Rs.500.

The fee was paid through the Khajane-2 portal. A sample challan is shown below for reference.

HELPFUL NOTES AND TIPS

  • Consulate Communication: Phone calls to the Osaka-Kobe Consulate at (+81-6-4963-3219) were unanswered. However, we received a prompt and helpful response via email at cons.osakakobe@mea.gov.in. The appointment was confirmed within 3 days.
  • Signing Protocol: The POA must be signed in the presence of consulate staff. Do not pre-sign the document.
  • PAN/Aadhaar Mention: If the POA references PAN or Aadhaar, carry these documents to the consulate for verification.
  • Timings:

Submission: 9:00 AM – 11:30 AM

Collection: 3:00 PM – 5:00 PM (same day)

  • Witness Requirement: It is not mandatory to bring witnesses to the consulate. Their signatures can be added in India after attestation.
  • No Apostille or Notary Needed: Consulate General attestation is sufficient for most legal purposes in India. It is also more cost-effective than a local notary or Apostille process in Japan.
  • Applicable to OCI Holders: This process applies equally to Indian passport holders and Overseas Citizen of India (OCI) cardholders.
