What are the ways to transfer a property from parent to children?

The best way to transfer property from parent to children is **GIFT DEED** because the transfer of property is effective immediately after registration and the stamp duty is just Rs.5000

Documents required for Gift Deed:

  • Identity Proof of parent and children (Donor and Donee)
  • Identity proof of two witnesses
  • Registered Deed (of how the Donor acquired the property)

Procedure to execute a Gift Deed:

  • Draft the Gift Deed
  • Pay the Stamp Duty
  • Register the Gift Deed in sub-registrar office

One of my clients wishes to gift a property to his daughter, and we assisted him in registering the gift deed in a sub-registrar office in Bangalore. Refer to below Gift Deed image


Few other ways to transfer property from parent to children are:

  • WILL
  • Sale Deed
  • Relinquishment Deed

There are certain advantages & disadvantages and we shared below:

1. WILL: is a legal document that expresses a person’s (testator) wishes to distribute his/her property after death

  • Transfer of property becomes effective after the testator’s death. Will is not mandatory to register but registering WILL enhances the authenticity of the document
  • Registering WILL is an affordable option because there is no stamp duty, the registration fee is just Rs. 200 and we can register in any sub-registrar office (not restricted to jurisdiction)

For Example, if your property is in Mumbai and you live in Bangalore, you can register the WILL in Bangalore.

  • As the situation changes, a person’s preference may change. Will can be updated or modified as many times as necessary. Whereas other deed like Gift Deed and Sale Deed cannot be updated or modified once registered

Documents required for WILL:

  • Identity Proof of Testator (person giving the WILL)
  • Identity proof of two witnesses
  • Not required to furnish property title documents in sub-registrar office for registration of WILL

Procedure to execute WILL:

  • Draft the WILL
  • Pay the registration fee
  • Register the WILL in sub-registrar office

  1. Sale Deed: is a legal document that transfers property ownership from parent to children in exchange for monetary consideration. The ownership transfer becomes effective immediately after the registration

Registration of Sale Deed incurs a high stamp duty of 5% consideration or guidance value, whichever is higher. Apart from stamp duty, the TDS is applicable

Instead of paying such high stamp duty and TDS for Sale Deed, we could choose gift deed because the stamp duty is just Rs. 5,000 and no TDS. Generally, the Sale Deed is most suitable for dealing with non-family members. Since you are family members, you must take advantage of stamp duty and taxation

Documents required for Sale Deed:

  • Identity proof of seller and buyer
  • Identity proof of two witnesses
  • Title documents (of how seller acquired the property)

Procedure to execute Sale Deed:

  • Draft the Sale Deed
  • Pay the Stamp Duty
  • Register the Sale Deed in sub-registrar office

  1. Relinquishment Deed: is applicable when a parent wishes to release their share in a jointly owned property to children

For example, a Father, mother, and daughter are legal heirs to a property. Father and mother can release their share to daughter by registering the Relinquishment Deed.

The transfer of ownership becomes effective immediately after the registration, The Stamp Duty is around Rs. 5,000

Documents required for Relinquishment Deed:

  • Identity Proof of parent and children (Releasor and Releasee)
  • Identity proof of two witnesses
  • Title documents

Procedure to execute a Relinquishment Deed:

  • Draft the Relinquishment Deed
  • Pay the Stamp Duty
  • Register the Relinquishment Deed in sub-registrar office

How do I register a gift deed for a property on Kaveri online services in Karnataka?

Gift Deed is a legal document that transfers property ownership from one person to another as a gift. Gifting is a voluntary act and does not have to pay consideration

  • The person who gives the gift is known as “Donor
  • The person who receives the gift is known as “Donee

Gift Deed is commonly used for transferring property because of NIL consideration and attracts less stamp duty among family members


Gift Deed draft should consist of the following information:

  • The place and date on which the gift deed is to be executed
  • Information regarding donor and donee, such as their names, relationships, ages, addresses, and signature
  • Complete details about the property, such as Property Number, Building name, village, Hobli and Taluk
  • Two witnesses’ signature

Documents required for Gift Deed Registration:

  • Registered Deed (of how donor acquired the property)
  • Gift Deed draft
  • Ekhata
  • Aadhaar of Donor and Donee
  • Two witnesses and their Aadhaar

Context: Husband gifts 2BHK residential flat to wife. The property is in BBMP jurisdiction in Bangalore. We followed the below procedure to register the Gift Deed


Visit the official website of Kaveri Online Services, the website link is Kaveri Online Services (karnataka.gov.in).

Click on the Register and Create an Account. We highlighted the Register tab in the below image

We need name, Gender, email ID and mobile number to create an account, refer to the below account creation page

 

Your email ID is the username and password that comes to your email. Login using your email ID and password. We highlighted the login tab in below image

After login, click on “Start a New Application”, Refer to the below image

Click on “DOCUMENT REGISTRATION”, refer to the below image

Click on “Continue”, refer to the below image

In Article and Sub Article, select the following option from the dropdown list

  • NATURE OF DOCUMENT: Gift deed
  • ARTICLE: Gift
  • SUB ARTICLE: 28(b)(i)- Gift Deed (WITHIN FAMILY DEFINITION) Immovable property situated within limits of BMRDA,BBMP or City Corporation

Click on Continue, refer to below image

Select NON-AGRICULTURAL, refer to the below image

Do you have e-Khata?

I don’t have e-Khata, hence I selected “No”. Refer to the below image

I have not applied for e-Khata yet, so I selected the reason “Have not applied” from the dropdown list. Refer to the below image

Click on Submit & Continue

(Edit on 8th Nov 2024: ekhata is mandatory for the registration of gift deed)


Enter the property description, which includes

  • DISTRICT
  • WARD NUMBER
  • INDEX II: VILLAGE
  • Zone, ROAD
  • Flat No. /Apt No.
  • Total Area (in Sq. Meter)

Click on Add More and add additional property descriptions like Survey number, Khata number, etc.. Refer “Add More” option in below image

We added Survey number of the property, Refer to the below image

Click on Submit & Continue

Based on the property description provided above, my property search is below

Click on Save Property & Continue


Enter the property schedule, such as East-to-West measurement, North-to-South measurements. Boundaries and description of property

I copied Schedule A, B, and C from gift deed draft and pasted in the Description of Property

Similarly, I copied boundaries from gift deed draft and pasted them here, as this will save my time and effort from typing. Refer to below filled image

Click on Save and Continue


As per the context, one donor (husband) and one donee (wife). The total number of executant is 2

Selected 2 in Number of Executant, Refer to the below image

In Executant -1: we entered the details of Donor (husband details)

  • Is Claimant: Select No
  • Individual Or Organization: Select Individual

Followed by the details of Salutation, Name, Mobile Number, Relative’s Name, Age, Gender, ID No and address. Refer to below-filled image

Click on Save Executant -1 And Go To Next

In Executant -2: we entered the details of Donee (wife details)

  • Is Claimant: Select Yes
  • Individual Or Organization: SelectIndividual

Followed by the details of Salutation, Name, Mobile Number, Relative’s Name, Age, Gender, ID No and address. Refer to below-filled image

Click on Save Executant -2

Click on Move to PRESENTER


Choose Presented from dropdown list, we can choose either Donor or Donee. I chose Donor and click on “Make Presenter”. Refer to the below image


 

In IDENTIFIER -1: enter the details of the witness, such as Name, Age, Gender, Relative’s Name, Address

In IDENTIFIES: Select Donor from dropdown list (this means Identifier – 1 is witnessing to the donor). Refer to below image

Click on Save IDENTIFIER -1 And Go To Next

In IDENTIFIER -2: enter the details of another witness, such as Name, Age, Gender, Relative’s Name, Address

In IDENTIFIES: Select Donee from dropdown list (this means Identifier – 2 is witnessing to the donee). Refer to the below image

Click on Save and Continue


Allocate this schedule to: Select Donee from dropdown list, Refer to the below image

Click on Save and Continue


Gift Deed does not require market value calculation, refer to below image

Click on Continue,


In fee calculation,

Click on Save and Continue, refer to the below image

My Gift Deed draft consists of 18 pages, and 18 are entered in the number of pages. Refer to below image

Click on Calculate

My total government fee including stamp duty and registration fees appears. My fee is Rs. 7,385. refer to the below

Click on Save and Continue


Review your data for corrections on the final page before submitting your application for approval. Refer to the below final page

Scroll down to the bottom of the page and do the following:

  • In Upload Deed Document: Upload Gift Deed draft in pdf (file size less than 5MB)
  • In Date Of Execution: Select the date mentioned in Gift Deed draft that you uploaded above
  • In Upload Annexures: Merge the property tax receipt, Khata, donor ID proof, Donee ID proof in one PDF and upload (file size less than 5MB)
  • In Select Sub-Registrar Office: Select sub-registrar office from dropdown list. I want to register this Giff Deed in Gandhinagar sub-registrar office, hence I selected Gandhinagar

Click on Agree and Submit


Our application was approved in 3 working days + we paid the government fee + Booked the slot for registration

As per our registration slot, we carried following documents to Gandhinagar sub-registrar office

  • Printout of Application summary report

  • ID proof of Donor and Donee

How can I get gift deed for a property (flat) in Bangalore?

The gift deed is a registered document through which the property owner transfers property to another person without consideration as a gift.

The person gifting property is called the Donor, the person accepting the gift is called Donee


 

4 Step procedure to Gift a property in Bangalore:

  1. Documents:

To register a gift deed, the donor & donee should have the following documents

  • Donor’s registered deed (Sale deed, gift deed, partition deed, Release Deed, WLL Etc..)
  • Encumbrance certificate
  • Tax paid receipt
  • Khata certificate & extract
  • Donor’s Aadhar and PAN
  • Donee’s Aadhar and PAN

 

2. Drafting:

3. Government fee (Stamp Duty & Registration fee) :

The government fees are different for blood relatives and non-blood relatives. The following people come under blood-relative category

  • Father
  • Mother
  • Brother
  • Sister
  • Husband
  • Wife
  • Son/Daughter

Uncles, cousins, nephews, and in-laws don’t come under blood-relative category

Following are the government fee for blood relatives:

  • Stamp Duty: Rs. 5000
  • Registration fee: Rs. 1000
  • Scanning Rs. 35 per page

Following are the government fee for non-blood relatives: (below % is based on the guidance value)

  • Stamp Duty: 5.1%
  • Registration fee: 1%
  • Cess: 0.5%
  • Scanning Rs. 550 (approx)

 

4. Registration:

Below is the step-by-step procedure to register the gift deed in sub-registrar office

Step 1: Submit the applciation on Kaveri Online Services https://kaveri.karnataka.gov.in/landing-page

Must have following documents to submit an application

  • Donor’s registered deed (Sale deed, gift deed, partition deed, Release Deed, WLL Etc..)
  • Tax paid receipt (of current financial year)
  • eKhata
  • Donor’s Aadhar and PAN
  • Donee’s Aadhar and PAN
  • GIFT DEED draft (to be registered)

Step 2: Appliction get approved within 2-3 working days, pay the government fee and book the registration slot

Step 3: Print the Gift Deed draft on document paper. Donor & Donee sign the Gift Deed

Step 4: The following documents to sub-registrar office for gift deed registraton

  • Application summary report
  • Gift Deed (to be registerd)
  • Aadhaar of Donor and Donee
  • Govenment fee trsnaction recept
  • Two witness and their aadhaar

The donor and donee sit in front of registration counter, officer takes the photo of donor & donee via webcam placed on computer monitor, takes biometric thumb impression and OTP authentication

Step 5: Officer scans the gift deed for government record and have over the hardcopy to presenter (Donor or Donee)

Who is responsible in paying stamp duty in gift deed? doner or donee?

In Gift deed, the stamp Duty and Registration charges are paid either by Donor or Donee

The important is to pay all government charges including stamp duty and link the payment reference number to registered gift deed

For Example: In Bangalore, the government charges are paid on Kaveri Online Services and generate transaction reference number. We encircled the reference number in below image

As per the above image, my reference number is CR0422003000297855, the same number is linked to my below-registered gift deed.

5. REGISTRATION: 

Step 1: We need following to submit the Gift Deed application on Kaveri Online Services

  • Donor’s registered deed
  • ekhata
  • Current financial year tax paid receipt
  • Donor’s Aadhar
  • Donee’s Aadhar
  • Printed GIFT DEED for registration (to be registered)
  • Active mobile phone to receive OTP

Submit the application on Kaveri Online service, the application approves within 2-3 working days, pay the government fee and book the registration slot

Step 2: As per your registration slot, carry the following to sub-registrar office

  • Application summary report
  • Donor and Donee Aadhaat
  • Two witnesses and their Aadhaar

Step 3: The chamber officer verifies above-listed document

Step 4: The donor, donee and two witnesses sits in front of registration counter for photo, thumb impression and gets Aadhar-based OTP authentication.

Step 5: Registering officer Handover the registered gift deed to presenter (Donor or Donee).
