***GIFT DEED***
Mother can transfer the property through a gift deed, out of love and affection. Following is the transfer cost
- Stamp Duty: Rs. 5000
- Registration: Rs.1000
- Scanning Rs. 35 per page (Rs. 350 approx. 10 pages)
Total Rs. 6,350 (Approx.)
Following are the required documents
- Registered Deed (of how mother acquired the property)
- Mother’s Aadhaar and PAN
- Son’s PAN
- Tax receipt
- eKhata
You, your mother and two witnesses must present in sub-registrar office for registration of gift deed.
If you couldn’t come to India for registration of gift deed, you can grant Power of attorney to mother from USA. Mother can sign the gift deed in sub-registrar office on your behalf.
(Mother signs the gift deed as Donor and also signs the gift deed as Donee on your behalf)

Below are the steps to register gift deed in Bangalore:
Step 1: Grand the power of attorney to Mother
Step 2: Draft the gift deed in Word document
Step 3: Submit the application in Kaveri Online service + Pay the government fee (Stamp duty & registration fee) + Book the registration slot
Step 4: Print the Gift Deed draft on document paper
Step 5: Visit the sub-registrar office and register the gift deed
After the gift deed registration, transfer the khata from mother name to your name. We need following documents for transfer of Khata
- Parent Deed (how the mother acquired the property)
- Gift Deed
- Donor’s Khata (Mother’s Khata)
- Tax receipt
- Aadhaar (Since you are a OCI, you may not be having aadhaar. If you give power of attorney to mother, mother can file the khata application on your behalf. File the application using mother’s aadhaar, Aadhaar is mandatory for e-sign the Khata application. As an alternative, you can give an affidavit instead POA to represent the Khata application)
Note:
- If the property was self-acquired by mother, mother can gift the property to you
- If the property was inherited by mother. You, your sibling and father are legal heir. You may need to register relinquishment deed with your family members to acquire complete share in property.
