What is the procedure to cancel General Power of Attorney in Karnataka?

General Power of Attorney (GPA) is executed in two types

  1. Executed in India
  2. Executed in abroad (NRI)

The cancellation procedure is different for both types of GPA. Below, we explained the detailed procedure


  1. Executed in India:

If the GPA was registered in India, below is the step-by-step procedure to cancel the GPA

Step 1: Prepare the draft in Word file. The draft looks like the below image

 

Step 2: Submit the application on Kaveri Online Services for registration of “Cancel GPA”. Usually, application approves within 2-3 working days, pay the government fee and book the registration slot

Documents required to submit an application on Kaveri Online services

  • Copy of the GPA
  • Cancel GPA Draft
  • Executant Aadhar
  • Two witnesses’ Aadhaar

The following are the government cost:

  • Stamp Duty: Rs. 1000
  • Registration fee Rs, 200
  • Scanning Rs 35 per page

Step 3: Print the “cancel GPA” draft on document paper. Executant signs all pages of “cancel GPA” and two witnesses sign at last page

Step 4: As per the registration slot, carry the following documents to sub-registrar office

  • Application summary report
  • Cancel of GPA (to be registered)
  • Stamp Duty and Registration payment receipt
  • Aadhaar
  • Two witnesses and their Aadhaar
  • Active mobile phone for OTP Authentication

Step 5:

  • Submit the above-listed documents in the registration couter
  • You and the witnesses will be asked to sit at registration counter for bio-metric thumb impression, webcam photo, and OTP authentication
  • The officer scans the Cancel GPA for digital record and hands back the registered “cancel GPA” to you.

NOTE:

  • Executant presence is mandatory in sub-registrar office to cancel the GPA
  • Attorney presence is not mandatory in sub-registrar office to cancel the GPA
  • After registering “CANCEL OF GPA”, you may publish in two newspapers, one in local language and another in English language newspaper

 

2. Executed in abroad (NRI):

If the GPA was executed in abroad, below is the step-by-step procedure to cancel the GPA

Step 1: Prepare the draft in Word file, the draft looks like below image

 

Step 2: Print draft on A4 size paper in the country where you live

Step 3:

  • Meet the notary public in your country.
  • The executant signs the “CANCEL OF GPA” in front of notary and notary attests “CANCEL GPA” with seal and sign

Step 4:

  • Prepare the request letter in Word file and take a printout on A4 size paper
  • The executant signs the request letter.

Step 5: Send the following documents to your agent in India (It could be an agent or your family member who could do the groundwork for you in India)

  • Notarized “CANCEL OF GPA”
  • Request letter
  • Self-attested passport copy
  • Photocopy of GPA

Step 6: The agent in India, Carries the following documents to District Registrar’s office, in the jurisdiction where the property is located

  • Notarized “CANCEL OF GPA”
  • Request letter
  • Self-attested passport copy
  • Photocopy of GPA
  • Payment receipt (Stamp duty)

Step 7: In the District Registrar’s office (DRO), officer verifies the above-listed documents and adjudicates the “CANCEL OF GPA”, The adjudication fee is Rs. 500

NOTE:

  • Executant presence is not required in India to adjudicate the “CANCEL OF GPA”
  • Attorney presence is not required in Registrar’s office
  • After Adjudication of CANCEL OF GPA, you may publish in two newspapers, one in local language and another in English language newspaper
