How do you gift immovable property from husband to wife?

Husband can gift immovable property to wife. Three simple steps to gift an immovable property:

  1. Drafting
  2. Government fees
  3. Registration

  1. Drafting:

Draft the gift deed in word file, the draft looks like below image

Print the draft on document paper.


 

  1. Government fee:

The following government fee is subject to Karnataka

  • Stamp Duty: Rs. 5150
  • Registration fee: Rs. 1000
  • Cess on stamps: Rs. 500
  • Scanning fee: Rs. 550 (approx)
  • Affidavit: Rs. 40

Pay the government fees, below image is the payment challan

 


 

3.   Registration:

Carry the following documents to sub-registrar office

  • Husband’s registered deed
  • Latest tax-paid receipt
  • Khata
  • Aadhaar (husband & wife)
  • PAN (husband & wife)
  • Government fee payment (challan)
  • Printed gift deed (to be registered)

In sub-registrar office, officer verifies the above-listed documents and approves for registration

Husband and wife are asked to sit at the registration counter for biometric thumb impression and webcam photo.

Husband, wife, and two witnesses sign the gift deed. The gift deed looks like below image

This completes the procedure to gift a property to wife.

Note:

  • If the property is solely owned by husband, husband can gift property to wife
  • If the property is jointly owned by husband and wife, husband can release his share to wife by executing release deed.
