How do I get a copy of a registered will from a sub-registrar’s office if the testator is dead?

If the Testator is no more, we can submit the following documents to the same sub-registrar office where the WILL was registered

  • Testator Death certificate
  • Applicant ID proof (Preferably Aadhaar)
  • FORM 22 (Application Form)

The fee for certified copy is around Rs.50, payable in the sub-registrar office’s name. The sub-registrar office searches and provides the certified copy within 7 working days


Let me share my similar experience for your better understanding:

My client Mr.Shyam is 78 years old and lives in Mumbai. His son Mr. Rohit registered a WILL in Indiranagar sub-registrar office in Bangalore, in the year 2023.

In Jan 2024, Mr. Rohit died. After Mr. Rohit decease, his father Mr. Shyam was not able to find the WILL and he didn’t know the registration number as well

Mr.Shyam e-mailed us the following documents:

  • Rohit’s Death certificate
  • Shyam’s Aadhaar
  • Scanned copy of FORM 22

We submitted the above documents to Indiranagar sub-registrar office in Bangalore. We paid the government fee of Rs. 200.

In 3 working days, we received the below WILL-certified copy

 

NOTE:

  • WILL is a private document, stored in Book No. 3. The Book No. 3 documents are not accessible to public. This means WILL documents are inaccessible in public records like encumbrance certificates (EC). WILL registration data is not inaccessible in EC search
  • We cannot download the WILL-certified copy online even if we have the registration number. Refer to the reason mentioned in below image

  • We can get the WILL-Certified copy only in the same sub-registrar office where the WILL was registered
