How can I cancel General Power of Attorney (GPA) in Karnataka?

A General Power of Attorney (GPA) is a legal document that grants authority to an individual (the attorney) to act on behalf of the principal (executant). The procedure to cancel General Power of Attorney varies based on where it was executed. Below is a step-by-step guide for both scenarios:

  1. Cancellation of GPA Executed in India

If the GPA was registered in India, follow the steps outlined below to cancel it:

Step 1: Draft the Cancellation Document

Prepare a draft of the “Cancellation of GPA” in a Word document. The draft looks like the below image

Step 2: Submit an Application on Kaveri Online Services

  • Log in to Kaveri Online Services and submit an application for the registration of “Cancel GPA.”
  • The application is typically approved within 2-3 working days.
  • Pay the government fees and book a registration slot at the Sub-Registrar Office.

Documents Required for Submission:

  • Copy of the existing GPA
  • Draft of the “Cancel GPA”
  • Aadhaar card of the executant
  • Aadhaar cards of two witnesses

Government Fees:

  • Stamp Duty: Rs. 1,000
  • Registration Fee: Rs. 200
  • Scanning Charges: Rs. 35 per page

Step 3: Print and Sign the Document

  • Print the “Cancel GPA” draft on document paper.
  • The executant must sign all pages, and both witnesses must sign the last page.

Step 4: Visit the Sub-Registrar Office

On the scheduled date, visit the Sub-Registrar Office with the following documents:

  • Application summary report
  • Printed “Cancel GPA” document
  • Payment receipts for Stamp Duty and Registration fees
  • Aadhaar card of the executant
  • Aadhaar cards of two witnesses
  • Active mobile phone for OTP authentication

Step 5: Registration Process

  • Submit the documents at the registration counter.
  • The executant and witnesses must complete biometric verification, webcam photo capture, and OTP authentication.
  • The officer will scan and digitally record the “Cancel GPA.”
  • The registered cancellation document will be returned to you.

Important Notes:

  • The executant’s presence is mandatory at the Sub-Registrar Office.
  • The attorney’s presence is not required for the cancellation.
  • After registration, you may publish the cancellation notice in two newspapers (one in the local language and one in English) for public record.

  1. Cancellation of GPA Executed Abroad (NRI)

If the GPA was executed outside India, follow the steps below to cancel it:

Step 1: Draft the Cancellation Document

Prepare a draft of the “Cancel GPA” document in a Word file. The draft looks like image below

Step 2: Print and Notarize the Document

  • Print the draft on A4-sized paper in your country of residence.
  • Visit a Notary Public and sign the document in their presence.
  • The Notary Public will attest the “Cancel GPA” with their seal and signature.

Step 3: Prepare a Request Letter

  • Draft a request letter for cancellation in a Word document.
  • Print it on A4-sized paper and sign it.

Step 4: Send Documents to an Agent in India

Send the following documents to an agent or family member in India who will complete the process on your behalf:

  • Notarized “Cancel GPA”
  • Signed request letter
  • Self-attested copy of your passport
  • Copy of the original GPA

Step 5: Submission at the District Registrar’s Office

The appointed agent must visit the District Registrar’s Office in the jurisdiction where the property is located with the following documents:

  • Notarized “Cancel GPA”
  • Signed request letter
  • Self-attested passport copy
  • Copy of the existing GPA
  • Payment receipt for Stamp Duty

Step 6: Adjudication Process

  • The District Registrar will verify and adjudicate the “Cancel GPA.”
  • The adjudication fee is Rs. 500.
