Can a Husband Transfer Property to His Wife?

Yes, a husband can transfer property to his wife in India. There are several recognized methods to do so, each serving different legal and personal considerations. Below are the three most common ways to transfer property from a husband to his wife:

  1. GIFT DEED

A Gift Deed is the most straightforward and popular method to transfer property from a husband to his wife. It is preferred due to its lower stamp duty charges and the immediate effect it has on ownership once registered.

Government fees for Gift Deed registration in Karnataka:

  • Stamp Duty: ₹5,000
  • Registration Fee: ₹1,000
  • Scanning Fee: ₹35 per page

Once executed and registered, the wife becomes the legal owner of the property with full rights.

  1. RELEASE OR RELINQUISHMENT DEED

A Release or Relinquishment Deed is applicable when both husband and wife are co-owners of a property. Through this deed, the husband can relinquish his share in favor of his wife, thereby making her the sole owner.

Government fees for Release/Relinquishment Deed registration in Karnataka:

  • Stamp Duty: ₹5,000
  • Registration Fee: ₹1,000
  • Scanning Fee: ₹35 per page

This method is suitable in scenarios where the property is jointly held.

  1. WILL

A Will is a legal document in which a husband can declare his intention to transfer the property to his wife upon his demise. Unlike a Gift or Release Deed, the ownership transfer under a Will takes effect only after the husband’s death.

Government fees for Will registration in Karnataka:

  • Stamp Duty: Not applicable
  • Registration Fee: ₹200
  • Scanning Fee: ₹35 per page

Although registration of a Will is not mandatory, doing so adds legal strength and authenticity.

ADDITIONAL OPTION: GENERAL POWER OF ATTORNEY (GPA)

A husband may also execute a General Power of Attorney in favor of his wife, authorizing her to manage, lease, or even sell the property on his behalf. However, GPA does not confer ownership and is not a substitute for actual transfer.

  • Stamp Duty: ₹1,000
  • Registration Fee: ₹200
  • Scanning Fee: ₹35 per page

Note: All the above transfers must be registered at the sub-registrar’s office by paying the prescribed government fees (stamp duty and registration charges).
