Land is A-Khata and individual flats are B-Khata because of un-approved development such as deviation from approved building plan
Most of the B-Khata flats are priced less and are often available for possession more quickly than A-Khata Flat
Recently, my client purchased a B-Khata flat built on A-Khata Land. The reason for the B-Khata is that the Builder didn’t give enough space between the building and the compound, which caused the deviation from the approved plan.
My client perceives that Bangalore has many B-Khata Flats built on A-Khata land, hence, he thinks buying a B-Khata flat would not be a significant problem and didn’t consider deviation a major issue. My client purchased a B-Khata flat in Sultanpalya, Bangalore. This apartment comprises just 12 units and is ready for possession.
Although the property has deviation and its B-Khata flat, my client purchased this flat for the following main reasons:
- Location is close to his office hence it reduces his travel time
- Priced within his budget
- Ready for possession with all basic civic amenities like electricity, water and sewage treatment
- The land owner & builder have paid the land tax & betterment charges etc..
My client had certain disadvantages in buying this B-Khata flat, such as low resale value and difficulty securing a home loan. However, my client purchased this flat for self-possession, which means he lives in the flat, so he is not concerned about resale value (only the investors are more concerned about resale value). My client managed to secure a home loan from a nationalized bank with slightly higher rate of interest
The builder and my client registered this flat in sub-registrar office without Occupancy certificate.
We are able to transfer the Khata to my client’s name because the builder has already completed the Khata bifurcation for the apartment. If the builder had not completed the bifurcation, we would had difficulty in transferring khata to my client’s names

Also, we got PID number from BBMP and paying property tax for this B-Khata flat
My client wouldn’t purchase this flat if it is under construction because getting basic civic amenities for B-khata property is challenging and it’s too risky to buy B-Khata under-construction property although we get deep price advantage
